State Specific Question About: OREGON (OR)

Tenant in mobile home park turned us into the city for building a fence around trash dumpster and said it was red tagged, a city employee had been there,no permits etc. and wanted to be informed of what the city would do to us, to keep her updated. This was all done to us after they were given a notice of breaking the rules/regs in mobile home park.This is harassment and if I did this to a tenant I would be in trouble--what about my rights?Any advise or anything I can do about it? Everything we did was legal and I had to spend about 3 hours of my time getting it straightened out at city hall.

What it is ... is retalition. However the laws are slanted on retailitaion that only tenants can retaliate which is not true.

Lets get the facts straight.

Fact #1.)

You built a fence around the trash dumpster.

Fact #2.)

Every fence in Long Beach CA needs a permit by law.

Fact #3.)

Most do not get a permit for a fence because code enforcement doesn't make a big deal about it.

Fact #4.)

IF you have a problematic neighbor or you are a Landlord/owner of income property. Cover yourself and get the permit. So tenants or nasty neighbors can't put you in this sitch.

Fact #5.)

You gave the tenant a notice of breaking rules.

Fact #6.)

Tenant calls the city reports the no permits.

Fact #7.)

If you evict this tenant in under 6 months(CA law) they will pull the retalition card and probably win

it.

Is it fair? Nope

Will it change? Maybe.

This is a business. You need to CYA better than your tenants. Walk on the right side of the law no matter what.
