Our tenant was divorced and has two young kids. Recently, her mother came to live with her to take care of her daughter. Her mother was very picky and requesting replace windows because of draft. My husband was very upset after heard her mother earful. Our lease said guest stay over 15 days without owner's written consent shall be considered breach of lease. What should we do? Thanks.

Serve a cure or quit notice for whatever time frame your state law requires. If MIL doesn't move, evict. If you're on month to month just give 30 days notice that tenancy will terminate. If mother moves out, you can always ask if tenant would like to stay. Make sure she is out BEFORE you agree to let tenant stay.

In MO we are not required to serve cure or quit. As long as I prove she's there, I can get rid of both of them. This is a bit challenging though. Receiving mail at an address isn't enough. Ask for a copy of MIL's current rental agreement or a copy of last month's mortgage payment and/or a utility bill at a separate address that lists her name. If they refuse, you can try asking a local experienced LL / tenant attoney what to do next. Avoid trying to photography or record them as this might be construed as stalking. In the end, your best defense is to find some way to evict for damage to the unit and/or late rent. Does your lease state that you can bill for guests? If so, start applying rent towards the guest bill first, then they are late with rent. Late with rent is much easier. If you go to trial, the judge will want to know why the tenant moved MIL in without your permission and he'll either tell her to move out or pay up and shut up. --204.80.xxx.xx

I am gonna think outside the box, and take my lumps - if they come so may that be. Remind the tenant that you will need an application from the new adult tenant and that you will replace the faulty windows in exchange for raising the rent by something between 60-75 bux a month, this could be a win-win if they like the idea. You keep rented and they have better windows, of course they leave them when they go, whenever that may be. --99.147.xx.xx

Drafty windows can be cured by caulking around the edge of the trim and insisting that the tenant lock the window.

An unlocked window might as well be open a crack.

It's almost winter and the mom is an extra income so that you will get paid the rent. You can also install one of those plastic window kits for them or give them a few. Get the money and be nice to the tenant. --76.99.xxx.xx

Back the mother up a bit by telling her that she'll need to be on your lease to be requesting changes. Tell her very pleasantly that normally only the tenant can request any repairs or maintenance. While still being friednlly, hand her an application. "Once a guest is here over 15 days, they become an unauthorized occupant. Yes, I agree--first you have to decide if you want the MIL or not. If the MIL is acting as a live in babysitter so the tenant can WORK, then she is pretty necessary--but she aint free. Another adult doubles the water usage and wear/tear. I agree what Jody said that the MIL cannot make requests because she is not a legal tenant yet. Tell YOUR tenant--not the MIL--that if she stays you will require a full application and raise the rent another increment(your choice how much). Do your best to deal with the drafts issue WITHOUT splurging for new windows. You want to deal with the sitution w/o losing the tenant and having a vacancy. Right now your tenant is in violation of her contract. Tell her the way to correct that (and secure the MIL as childcare) is to follow your requirements. --140.140.xx.x
