State Specific Question About: CONNECTICUT (CT)

When a tenant first moves in, do they pay for the first full tank of oil, or is it customary for the landlord to pay for it and then the tenant leaves it full when their lease is up?

Also, the propane company has a yearly rental fee and a security deposit. Who normally pays this?

The tenant has a five year lease! And there is nothing in the lease that covers this.

Liz, assuming in your situation the resident is responsible for the oil, we deliver the house to them with the tank normally half to complete full. We mark or measure how much oil is in the tank, which the resident is in agreement with. The resident signs an agreement acknowledging the measurement and they agree that when they leave, it will be at least that same amount left in the tank (Similar to when you rent a car and agree to bring the car back with at least the same amount). If not, the resident will be charged for the amount of oil needed to bring the tank back to the level it was when they moved in.

To answer your question another way. If the tank is almost empty when they move in, they should not be held responsible for leaving the tank full when they move out. --70.161.xxx.xxx

Any other landlords out there do it differently?

My real estate agent told me that if they are paying for heat, then they should be paying for all the oil in the tank from day one.

We're talking about almost $2000 worth of oil and propane, so I'm not too happy about having to lay that amount of money out for 5 years!!! --70.21.xxx.xxx

You must of bought this property with tenants in house with a 5 year lease. Egads. Does the lease really say 5 years?

I'm in CA so I know squat about oil heating.

Logically whoever is in the dwelling is the one who would have to pay for the deposit/s.

Please understand, the reason we usually start off with some oil in the tank is because that is the amount left from the prior resident. In your case, if it is almost empty to begin with, there is nothing wrong with the resident filling it up. If that is the case, just don't require that they leave the tank full when they move out. --70.161.xxx.xxx

Josh,

My brother and I inherited the house and decided to rent instead of sell, until the market improves (fingers crossed!) We have next to no experience being landlords and perhaps foolishly agreed to a five year lease (with a 5% yearly raise) At this point, I wish the tenant would just make us an offer on the house since, you're right, she acts like she owns it!

I know, I know, we probably shouldn't even be in the LLing business. It's definitely a rough learning curve.

Maybe a naive question but: Why is a 5 year lease so bad? --70.21.xxx.xxx

For anyone else renting homes with oil tanks, there is some additional language that should be included in the rental agreement that is important.

* Resident is responsible for refilling the tank and agrees not to let the level of oil drop below __________ gallons at any time.

* If resident fails to keep the oil above this amount and as a result damage occurs, resident understands he or she will be obligated to immediately pay for any resulting damages or repair. --64.12.xxx.xxx
