State Specific Question About: WASHINGTON (WA)

Ok, someone answer this for me please? I have a renter, who has been on a yearly lease (two years) her lease is to end 30 of November and of course I have not received rent for this month (November) or late fee's for last month (did notified renter that it was late).

I had a friend serve (a) Notice to terminated tenancy (lease calls for 20 days notice...it's 24 days till the end of the month) (b)Notice to pay or Vacate & (c) a late notice.....friend discovers that there is a truck parked in the drive way and the man that opens the door tell friend that he is living there w/girlfriend (who is the only one on the lease by the way).....friend writes down license plate and has her husband (cop) run it and WOOOHHHH he's a level 2 Sex offfender that has listed my house as his current address?

Can I get them out sooner now?

WA does have allow a 3 day unconditional quit - but I don't know if your circumstances would hold up in court.

Your best bet is to evict them via the 3 day pay/quit.

Serving multiple notices on the same day can be argued in court as "confusing to the tenant". I would recommend that you go back and serve each notice on a single day. Make sure you personally serve if possible, and nail/mail(USPS first class) otherwise. I mail in all cases, even if I personally served them. Make sure your notices include the verbiage "AND TO ALL TENANTS IN POSSESSION" after the tenant's name.

You can serve these notices yourself.

Re: having your cop friend do a search, this may not be 100% legal, so you might not want to mention this. Sex offender data is available online, with pictures.

I think I would base the eviction on the unpaid rent and additional adult not authorized on the lease and leave your other stuff out of the press, let the press do the work themselves. Keep it simple, the tenant may bring drama into the picture - many of them feed off this, stick to the point, don't add any drama it only helps out the cough drop industry. --99.128.xx.x

i too would go after her on non payment.if u get proof he is there like mailbox or car in yard at 8 am sunday i would add that to eviction.i wouldnt mention level 2. --208.58.x.xx

Please for the cops sake, dont let anyone know he ran it for you. I know here it'll get you fired. Most have a reason to run the tag. However I would send go ahead with the eviction, if they pay up, then serve a cure or quit . Does your lease address extra occupants, does it address felons? --74.243.xx.xxx

Just give the the 3 day notice to quit. the Wa attorney gen. office spells out how to do it. Then go to the court house and they will help you with the process to evict.

Thanks for all the info....update....when I stopped by to show the place....asked the tenant how many people actully live there and her answer was "three".....she handed me a a few money orders for the rent and a "i'm moving at the end fo the month" letter at the same time! HA HA.......not a problem....

She has found another house on the next block that she has signed a lease with new landlord....good luck!!! Of course I never received a call but as I was leaving the new landlord showed up to have her sign the new lease...... Did she that she had started to pack too! She asked for her final walkthru on Wed before Thanksgiven...should I be happy or what? Seems our local utility company won't read meters on the Friday after T-day....she wants to be out and turned over to me prior....
