start with issueing the tenant a "10-Day Notice To Quit"....basically it can be simple and made up addressing the resident from you to them outling monies due and by when.... this is assuming you don't have them waiving notice in your lease....No problem most don't as they don't know they can do....
then on the 11th day go to the county courthouse and file eviciton papaers... go there now...they come with directions.....

Tyler.....I didn't know about the waiving 10 day notice!! I had heard from a local landlord that he makes the tenants waive the right to appeal - -he said his leas has been challenged and has held up in court for over 20 years..any experienc? How can the contract / lease over-ride landlord-tenant law?

Bibi, go right up to the top of this page to the Landlord/Tenent Laws link(in blue). Click on NC, and PRINT OFF the whole set of NC laws. Put them in a 3-ring binder on your desk. Now you have YOUR operating rules at your finger tips. --140.140.xx.x |
