Going over Idaho's LL guidelines I ran across this statement: "A disability includes a physical or mental impairment such as blindness, retardation, CHRONIC ALCOHOLISM...." Are they for real or what? As usual in this site, people have applied political ideology to a health situation. Alcoholics are covered because the health professions consider alcoholism an addiction and therefore a disease and you can't discriminate against people solely for that. You can, however, discriminate on the basis of being a drunk regardless of whether the person is an alcoholic! So the fact that a person is a recovering and sober alcoholic cannot be used as basis for an action, but the fact that they get drunk can be. RETURN OF THE SECURITY DEPOSIT

Any money deposited with a landlord is either “rent” or a “deposit.” Rent is non-refundable, while deposits are refundable and must be held in a special escrow account during the tenant’s lease term.

Idaho Statute

TITLE 55

PROPERTY IN GENERAL

CHAPTER 20

MOBILE HOME PARK LANDLORD-TENANT ACT

55-2013. DEPOSITS -- SECURITY. (1) Any payment, deposit, fee, or other

charge which is required by the landlord in addition to periodic rent, utility

charges or service fees, and is collected as prepaid rent or a sum to

compensate for any tenant default is a deposit governed by the provisions of

this section.

(2) The landlord shall maintain a separate record of the deposits.

(3) The provisions of sections 6-320 and 6-321, Idaho Code, shall apply

to landlords and tenants governed by this chapter.

(4) Upon termination of the landlord's interest in the mobile home park,

the landlord shall either transfer to his successor in interest that portion

of the deposit remaining after making any deductions allowed under this

section or return such portion to the tenant.

(5) The claim of the tenant to any deposit to which he is entitled by law

takes precedence over the claims of any other creditor of the landlord.

The above section states

(2) The landlord shall maintain a separate record of the deposits.

I read this as you must know how much each tenant has in a security deposit, I don't read this as maintaing a separate account as stated by Wasden.

What is your thought.

It is a better Landlord Tenant Guide than we have had before, as they even list the appropriate statues at the end. I will have to go through again and see what other changes they have made. I haven't done this for about 6 months.

I checked into this (or something simular) and an alcoholic is only protected if he/she is in a treatment program as recovering alcohlic. Has this changed???

If you want to see the damages a chronic alcholic can do to your property, see my video on the MrLandlord.com Video Paged titled "Post Eviction a True Story" or through the following link (remove the *). You won't see anything worse in regrads to a alcoholic tenant gone out of control.

Hi AJ,

I agree with you. I don't think you have to have a separate "account" as you should keep separate "written records." This is to clearly know what is security vs rent/etc., I'm guessing. When we moved here in 05- the last LL guideline update was 2003. Very minimal info. Now it's up to 46 pages (June 08). I'm glad they are getting better but it's still not good enough. AJ, just looked up in June 08. It simply states "The landlord must maintain a separate RECORD of deposits." I totally agree with your prev posting. Written records not separate accounts. The part that I put in about a special escrow account was copy pasted direct from Wasden's Landlord Tenant Guidlines from his site.

I did email him and asked him if this needed to be changed to reflect the actual statue.

I will let you know if I get a reply. I am also going to do some more research about an alcoholic. They would have to prove to me that they are getting disability check, I think. --72.22.xxx.xxx

This is hearsay but for what it is worth it comes from an insider in the system.

Richmond, Virginia is paying at least one person we know disability payments for being on drugs.

For the record, I use day labor all the time, if somebody comes up and wants to work I try to find something. The exceptions are if that somebody is on disability ...I won't hire. If they vandalized one of the shacks or harbor an individual who did...I won't hire.

But to answer your question. Yes, you can get disability payments for having "the sugar" and just about anything else you can imagine. --71.178.xxx.xx

This was copied directly from the City of Greeley's Rental Guidlines

The federal Fair Housing Act and Fair Housing

Amendments prohibit discrimination against

people who: Have a physical or mental disability that substantially limits one or more major life activity — including, but not limited to, hearing, mobility and

visual impairments; chronic alcoholism (but only if being addressed through a recovery program); mental illness; HIV, AIDS and AIDS-Related Complex and mental retardation; Have a history or record of such a disability; or Are regarded by others as though they have such a disability

From what I have found, they have to be in a recovery program as specified by Doctors and others.

At least for the working part they can be held to the same standards meaning they have to come to work on time and have to perform their job without impairment, but you would have to accomodate them for meetings and maybe give them memory aids, etc. So I would assume that you would be able to demand that they not tear your place up or make excessive noise, the same as you would demand from other tenants.

I have never found anything that says that we must pay interest in Idaho, as I have never found anything that says we have to have an escrow account. Most of the rental statutes are listing in Wasden's guidlines at the back. You can go to Idaho dot gov then laws and rules then statutes and look them up. Most are very short and to the point, but sometimes it will refer you to another statute.

I haven't heard from Wasden yet, but will let you know. The last time I contacted them they referred me to an attorney as they said they couldn't comment. I thought that was interesting since he is the State Attorney General. --72.22.xxx.xxx
