I have an elderly lady tenant who has been having financial difficulties for some time now. We have worked with her & have allowed her to pay 2 times a month. However, we are constantly having to call & email her to find out the situation. She never initiates the call/email or keeps us informed. I don't see her situation improving. I don't want to evict her if I can avoid it, as she is old & has no family. Legally, is there anything I can do to put her on notice to find a cheaper place to live? Would that be legal for me to put in writing? Any ideas?

Is she on a lease or MTM? Basically, most people here will tell you to just start eviction when she doesn't pay next time instead of working with her. But, that being said, I know that it isn't always that simple for a lot of us.

So, if you don't want to do it for non-payment... If she is on a MTM, then you could just send her a letter that you are terminating her MTM in X days (30? 60? 90?) -- however long you want to give her to try to force her to move and find some place cheaper. If she doesn't move, then you can do the normal eviction and not feel like you at least didn't TRY to do something else.

If it is a lease and she has more time left, then there isn't much you can do to force her unless she doesn't pay and you start the formal eviction.

Thanks for the info. She's on a MTM. I am just wondering if she gets govmt housing assistance? I know she has just started recvg food stamps. Is there anyway to tell if she gets help w/her rent via gmt housing? If she does, that could mean extra eviction work. --24.116.xxx.x

I'm not sure about this, but it seems to me that in most places, if a tenant gets assitance, then you would know about it. Most of the time the monies get sent straight to the LL. Even if its a partial amount. --74.243.xx.xxx

I think she needs to look for somewhere else that is cheaper, and she needs to apply for more forms of assistance, maybe section 8. The other thing you can do to help is to sit down and have a talk with her, that her being late on rent is not working out for you, and you are willing to assist her in looking for another place that is in her price range. I'd think that Section 8 was developed to aid deserving tenants such as yours. Why don't you look into it?

Also, call city, state, senior organizations, etc (found in blue pages of phone book.) Do whatever you can to get her the help she needs. --205.188.xxx.xxx

dont have all the info, and maybe Im completely off base, but perhaps try to treat her with compassion (at first).

You said she does not initiate any communication when she is late with the rent.

She may be embarrassed or my be having memory problems.

In any case I would probably put it to her something like this

-we enjoy having you "stay with us", the problem we are having is that we are very tight for money. We really need your rent to help pay the bills. If we dont get your rent a the start of the month we have to delay paying some of the bills.

We have been told that we cant keep paying late.

WE really need your help, what can we do to change this situation?

Gently get her to tell you that her rent is more than she can afford and therefore the only answer is that she moves.

This can be extremely tramatic for seniors.

Not all tenants are slimeballs. Plese abe very gentle with her. If she gets ugly then do what you have to. --74.12.x.xxx

Andrew (in Canada), I agree with you all. We have been very understanding. We are not the "evict the day they are late" types. We have always worked with our tenants & have great ones.
