State Specific Question About: WASHINGTON (WA)

I am preparing to rent to a couple that smokes. My rental home is a non-smoking property. Other than putting something in the least re: no smoking in the house - are there other items I can add to the lease - such as, if it is determined that they smoked in the house there is a fine, XXX amount due to completely repaint house and have smoke smell removed, etc.

no way can you keep them from smoking in your home. Put whatever you want in the lease..it will not matter...

they dont even care about their own bodies...why woud they care about your home?

IMO I doubt you could fine a smoking inside the dwelling tenant. Unless the state had laws and fines set up and in place. If the city/state is getting fine monies.

Penny, it doesn't matter if they agree to smoke outside. The stench clings to clothing / hair and anything they touch. The smell will come inside even if the smoke outside. Listen to the advice you've been given or you will be paying later to fix a problem. --204.80.xxx.xx

In ontario Canada, tenants are free to smoke as much as they want IN the apt as tehy wish: it doesnt matter what my lease says, or the damage they do when smoking. "its thier right".

Sid is right. I had a smoker in my duplex before I moved in. My duplex is a no smoking house and the tenant followed the rules as I was there everyday while working on the other unit. When he left (lived out of state but was on a temporary work assignment in New Jersey) his closet smell like an ash tray as the smoke clung (is that a word) to his cloths. It was not too hard to get rid of the smell, but if he smoked in the house I'd have a big problem.

We did the same thing (unknowingly) & rented a non-smoking place to a smoker (we didn't know & were not told). Made sure he understood he was not allowed to smoke inside.. Guess what? He smokes inside & my upstairs people let me know they can smell it. We put him on notice. Will probably have to evict since I can't imagin him wanting to go out in the snow & smoke.. I highly recommend NOT renting to smokers if you can find a more qualified applicant. --24.116.xxx.x

I rent to non-smokers. a big market and all my applicants & renters appreciate living in houses which have not been smoked in. I did have one college student replacement who did smoke, but he did always smoke outside. his room-mates made sure of that.

Landlords can prohibit smoking; it's legal to do so and many have done so to save money and reduce risk of fire. Check your state's landlord-tenant law for more on fines. Follow your usual enforcement procedure like you do for any other rule infraction. Put in your lease where they may and may not smoke. You can prohibit it on the entire property, if you like. You don't need to actually see smoking to know they are breaking the terms of the lease. Do regular inspections and if you see ashtrays, burn marks, smell smoke, or get complaints from neighbors, document it all.
