State Specific Question About: IDAHO (ID)

ive recently rieced a letter from my tenants stateing they were going to take rent money to complete the daylight basement,because the person that was going to do it that i had hired hasnt found the time to do so, they believe they can use the money that they pay for rent to fix this without my writen permission, now although unfinish it is livable, and is just that a basement with cement floors, and a laundry room, bath room, extra room what do i do if they try or do this,thank you --71.36.xx.xx

Tell them you will evict them if they take the rent.

Tenants are only allowed to do that if heat or water or electricity goes bad.

i was fixing it before they moved in, the agreement wasnt including the basement area, this was supposed to be for my son to stay, the tenants agreed, everything i own is still there, they said it could stay and they are useing them,and desroying , the yard has not been kept up , the house is a mess, can they do anything without my prior approval, plus they are demanding that i pay to have the pellet stove fixed or replaced, the main source of heat is electric and they have that, they just want cheeper heat wich i understand but they are not without heat, infact i just paid for a surge heater for them to reduce there heat bill. --71.36.xx.xx

What did you promise them about the basement when they signed the lease?

If you did not commit to finishing it, they need to pay the rent! If the rent is not paid on time, follow your state law to evict for non-pmt.

If you did commit, why is the job not done? Let them know a firm guideline of WHEN the promised work will be done, and follow through.

You expect them to honor their committment, you need to honor yours as well.

they also have offered to buy my home, i was put in a sittuation that i had no choice but to rent it out, i feel that they are trying to take advantage of me, when it came time to sign a lease they haddnt any time , im now in the city and they are at my home in the mountains, the drive is an hour, they have been there since may, can i evict them for not sgning a lease, also there is a houseing assosiation, the weeds in the yard are taller than i am, plus because it is in the mountains it poses a risck of fire. --71.36.xx.xx

From what you've written, I wouldn't mess with them any longer. Give them their 30 Notice, if allowed by your state, get them out and start fresh.

The damage is done at this point and they are trying to take advantage of you. Buying the house is BS, otherwise they'd given you an offer by now.

the tenants live derectly next door to me, the place they were liveing in was a 2 bedroom, they said they didnt have alot of belongings, i asked if i could leave my belongings there, the agreed, now they want me to come and get it, put i tin a storage shed, but they want me to leave the furniture portion behind or thier use, im a little freeked out sorry, but they gave exuses as why they havnt signed a lease, my exuse is i cant keep travleing back and forth to keep trying to get one and fail. --71.36.xx.xx

You say they are in the mountains and you are in the city - an hour's drive away. Yet you say they are next door to you.

If the basement is part of the single family house then your belongings should not be there. They should have a right to use the basement but your lease that they don't have should have stipulated YOUR rules and regulations - like no alternations without written permission.

Your mistake was giving the key without having them sign a lease.

You do not have to get them out or call a lawyer. However, you do have to TRAIN them.

Deliver the following to each tenant. Don't weasel out by mailing it. Hand a copy to each tenant and stand there while they read it (saying nothing).

"URGENT. You do not have my permission to spend MY money without my prior written permission!

Any repairs (including the basement repair)will be scheduled by me and paid only by me directly.

Your rent is due IN FULL on the first of the month."

Find a lawyer that is in the town where landlord tenant court is and tell him what's happening and ask for a flat fee for eviction. Don't take a lawyer that asks for a retainer as they don't intend to do anything except run up a bill as long as they can. Hurry up before the winter sets in and the snow is too high to do anything. The lawyer will know the sherrif and they will get these folks out and the lawyer will know someone decent to rent from you. --76.99.xxx.xx

If these people in your house have no signed lease, then they are there at you "sufference." If is called "tenants at will"--YOU WILL. They have NO RIGHTS right now. Immediately serve them a 30 day notice to vacate--with no reason given. They will argue with you and maybe start calling housing inspoectors, etc--but you will have the answer for that (they are tenants at will, they have threatened to not pay rent, threatened to do work on my house without permission, threatened to use my personal belongings stored in the basement, etc).

Immediately start research for a flat-fee attorney to evict them. This will not get any better. It is too late to train them. They have already taken over. --140.140.xx.x

this is the first, and only real corrispondance that i have seen or heard on their disadicfaction, I did give them permission to replace the breaker which provided them heat, but they want more, there is a pellet stove that they want fixed, i have already supplied them with electric heat and baught them a surge heater that cost 8 cents an hour to run. --67.42.xxx.xx

they are paying their utilities? I am wearing several wool pullovers while typing this ha ha. I would monitor them falling behind on the utility bills. Maybe the electricity provider can put a lien against your property?

They need to go! You will have trouble finding a clever tenant who will accept electric heat. Or they wear several pullovers...
