State Specific Question About: GEORGIA (GA)

I have a rental property in Forrest Park GA that I bought this year. The wholesaler had rehabbed it and he found me a property manager to rent the property. The tenants paid the first two months rent and then they lived there rent free for about three more months. September 22 we got some more tenants that said there was a leak in the master bathroom that is causing a mold problem that was making them sick. I had the leak fixed but the tenants are still complaining about mold. I have sent the insurance company over there to see if the insurance would cover the damage. This house has drained all of my resources and I am not able to hire someone to fix the property. Is there any place in Georgia where I can find some help before I get dragged into court? --70.178.xxx.xxx

Do you still have the property manager? I'd get rid of them if so. Did the mildew actually get cleaned up? (A cup of bleach to a bucket of water can work wonders on that. Clean & cover with Kilz where appropriate.)

Have you actually seen the damage? Smelled it? Or are you just depending on others at this point? I assume from your post that you haven't seen it. I would recommend that. Also, see if the bath vent fan works. Rehabbers don't always hook those up properly, and they are essential for removing the moisture that keeps the mildew alive & happy.

Managing a single rental property is not so hard. But it does sound like your tenants are setting you up to not pay their rent for a while. You can handle this. You are the Landlord. The Landlord is in charge. They will have to continue to pay rent, one way or another, even if it is to an escrow account. Your best bet is to get the mildew cleaned up as fast as possible. Also, hang out here for a while - you'll likely learn a lot!

Do double check as Elia mentions. Is this really toxic mold or is it mildew? The two are often confused and tenants will look for any excuse to avoid paying rent. I had a tenant once threaten to block my eviction suit against her (she hadn't paid rent) because there was a soft spot (3 inches by 1 inch) on the floor in the bathroom. We had already addressed in writing when and where I was taking care of that since she would not have use of the only bathroom in the house for a couple of days while I redid the floors. Missouri state law says you cannot deduct from rent or refuse to pay rent unless several things have occurred: 1) you must have county health inspectors visibly inspect the problem and send written notice to the LL of the problem 2) LL fails to correct the situation within 30 days of notice 3) tenant must pay rents into an escrow account to be disbursed once repairs have been completed.

Sounds like your folks have done none of the above. While your state laws are probably different, don't let their threats and stupidity cut into your cash flow. Diagnose the problem, correct the problem promptly, and insist that all rents be paid on time as agreed during the process. --204.80.xxx.xx

Yes, sounds like tenants are trying to scr@w you. It also sounds like it's time for you to become more involved in your property. I, for one, would never call an insurance company in to look at supposed 'mold' that a tenant reported. This is not something you want associated with this property on the CLUE report. I agree with others, the PM is a bumb, lose them.

The first thing you really need to do is find the water source for the mold. If it is just moisture from the shower then a ventfan will solve that. Run the fan at least half an hour after showers or baths.

Once you have solved the moisture problem, then focus on the clean-up. There are many products on the market targeted for mold clean-up. Try (kill mold fast dot com).

Finally, tenants may not ever go without paying rent. That is unacceptable. I repeat, fire that PM NOW. You are being taken. --74.215.xx.xxx

Also, if there is still an outside source of moisture, you must stop the moisture and remove any wet or damaged material of any kind, wood, drywalll, insulation or anything else. Only then can you really start the clean-up process. Just remember, mold can not grow without water or moisture.

Profeshonal mold remediation is very expensive. The last thing you want is to have your insurance company involved.

Tenants say the darndest things. They will leave food on the counter and complain they have roaches.

Solve this. Quickly. Attorneys LOVE this stuff.

Take photos before and after.

Have the tenant sign your paper saying the MILDEW issue has been resolved.

This is minor management / everyday problem. Tenants blow it out of proportion. Be courteous and and professional, and get it fixed. Don't let it discourage you. --69.243.xxx.xx
