I'm not sure what this means either, but I guess I'll take a stab at it. If a previous LL doesn't give your security deposit back, then your rights are to take them to small claims court. That doesn't mean you will win though. If it's 30 days they are supposed to mail you an accounting of where the security deposit went. If you did not leave them a forwarding address, then they sent it to the apartment that you were previously living and it may not have gotten to you yet. --167.6.xxx.xx

I am not sure what you are asking. Are you the tenant inquiring about what happens if your landlord doesn't return your security deposit within 30 days?

Generally a landlord is expected to mail you within 30 days a statement of the items withheld from your security deposit and at the same time return anything remaining in the deposit. If you did not provide a new address, then the landlord should have mailed it to the last known address - which would be the place you had rented. If you did not leave a forwarding address with the post office, then it would be returned to the landlord.

You might begin by calling the landlord and inquiring what happened.

My guess is that this is a sublease situation. I think ANOTHER tenant had a lease that they needed out of, so they subleased it to this person -- and took a deposit from them -- and now that everything is over with, didn't give theirs back.

In which case, this has nothing to do with your Landlord, so you'll have to deal with the other tenant that you subleased from. And this isn't the site for you, sorry.

Or -- it could be the reverse too -- maybe this was the original renter and they subleased to someone else -- who got the deposit back from the LL at moveout and didn't pass it along to the original tenant? In which case, that may have been a LL error, but we still can't help you much here. :)
