State Specific Question About: COLORADO (CO)

We gave a bad tenant a 6-week notice that we would not be renewing his lease and he is still there 11 days after it expired. What is the eviction process here? Do we have to give a 3-day notice or can we evict immediately? What do we do with all his junk? He has quite a temper so we've been treading lightly so far. Thanks. --24.8.xx.xx

You DON'T do a pay/quit because doing so will invalidate the previously served termination notice.

You check to see what the illegal holdover laws are in your state and then file accordingly.

In CA we can just go the first business day after the notice expires (or one more day if the last day falls on weekend/holiday) and file UD if they don't move by the last day of the notice. --207.200.xxx.xx

If you are not familiar and experienced with the eviction process, you should hire an attorney to handle this, get copies of how they do it, ask questions on how the process works, and learn from this one. If you make one mistake, it will get thrown out and you will have to re-file thus prolonging the agony and free rent. If this person has a history of temper, you do not know where temper turns to violence. The attorney will be worth every penny you pay. Earlier this year in Loveland, Colorado, a process server was killed while doing their job by someone who had a temper. The man with a temper was strangling his kids when the police arrived (it was a divorce case). For one of us to outline the process in filing an eviction would be practicing law without a license, so it really is best to learn it from a professional and try it on your own later on. --207.69.xxx.xx

In this state procedures are well known to tenants. Ordinarily it doesn't take an act of congress because multiple contingencies take effect whenever a process is entered into the works of the state such as liens and processes which ultimately easily cause bankruptcy and gumming up of the works. But I am more than indulgent but rudeness usually brings quick finality. It's all too easy to fix renters with any local registry. --4.153.xxx.xx
