OK Guys, remember my "3 Days Notice To Quit" discussion? Well here is te Update...I took you advice, and deliverd the Notce myself last night. I saw the TV and Lights on so i knew they were up, I heard voices and coughing, then I rand the doos bell and saw someone peeping through the window...YEP You guessed it...I rang the bell 11 more times waiting a while between each ring. Yes, you are right again...The lights went out then the TV was turned off. I stood there for over 10 minutes, I knocked on the door 5 times, still no respond...Then I said "OK no problem, You can speak to the Sheriff tomorrow"...that was the magic word, the wife came out saying they were asleep, I explained I am there to collect the rent, she started to give me the hard luck stories, I handed her the Notice asked her to sign, she took 15 mins after asking when do we expect them to leave, I told her "SECOND PARAGRAPH" she begged ensuring me she will pay by the 17th Fees and all....HA!!!! very funny, see ya ....You can leave the keys in the mail box if you don't feel like calling.....

QUESTION....Should I give them until the 17th?

The wife called me this morning begging and crying...

Their lease is up in January.. AND she did sign the paper and she wrote on both copies that she will pay on or before the 17th.

Absolutely not, follow through with the eviction. She should have paid on time. You have given her enough time as it is. You served her with the 3 day, if she hasn't paid by the end of the 3 days, file. Chances are she won't have the money on the 17th. --167.6.xxx.xx

Do you have it in your lease that she has to pay attorney fees? If you file, and she pays, that money goes towards attorney fees and late fees first, and then she still owes rent. Also, then you won't have anything left for cleaning or any repairs when they leave/get kicked out. Men are from Mars-that's not going to change...haha!!! --167.6.xxx.xx

Yes it is in the Contract about her paying the Attorney fees etc...Last month her husband threatned me to go to his attorney if I ask them to leave..I offered to purchase Gas for his car so he would reach on time...He said I was rude, but now He is sooooo QUIET...MEN !!!! well she will be calling me later and againg I will say "See Ya, keys can be left in the Mail Box" --74.166.x.xx

It's always a bit funny that people who haven't got the rent money seem to think landlords will buy the idea that they have "their attorney" waiting by the phone to be contacted by them.

Yes, file for the eviction today. If they do pay all fees on the 17 you can always canx it--but don't! Subtract the filing fees and the late fee and they are short from the rent. Once they are out you inspect, clean and repair, subtract those costs from the SD and subtract the rent amount owing. If the SD doesn't cover it all--send them a demand for the amt owed to you when you send the Deposit Accting letter.

You will go thru a similar hassle EVERY month with these folks. How long do you want to live like this? --140.140.xx.x

Proceed with court action...in GA the court will give them seven days to file an answer and if they don't, you can probably get a default judgment for possession. IF they pay within that seven days, the court may order you to let them stay this ONE TIME but they can only do that once in twelve months. --207.200.xxx.xx

Isn't it amazing how great some tenants without rent money are at acting? Now, if Hollywood producers would just tap some of them, we would never have to watch bad "B" movies again! Don't believe a bit of the crying routine. They ignored you at the door.

Oh, next time... Knock with the flat of your hand. You can get a great big noise that can be heard a block away without doing damage to your knuckles. How much are we talking about? I would feed the family for a week on Rahmen noodle soup 3 times a day. Take the bus to work if that saves gas. Call a friend or relative to raise the cash.

Being in such dire straits means they maxed out oin their friends as well. It might work on the 17th, but then you would repeat the whole thing on the 10th next month.

At times, I stayed without heating and the water in the kitchen was frozen. Folks need to learn how to adjust to having less money. They need to get their priorities straight. Cancel the cable but pay the rent. --78.42.xxx.xx

Good Day Team....I woke up this morning and I feel so good, why? The Tenant did not call, so I know they must be "Packing"....The (loud mouth)husband is as quiet as a mouse...and I paid the fee for the Dispossessory....The good thing is the 17th will come before the dispossesory is final..

CHRIS are you a Tenant or a LL? The problem here is the Husband...the wife only works 700.00 per mth, the husband takes home 1500.00 per week (Paystubs)well I hope he takes it home....she always has her portion (1/2) even after going to the grocery...then the crying starts...so its the DEADBEAT HUSBAND...the one with the Attorney that is dropping the BOMB....MEN!!!!! I wish I could tell her she does not need the rent she needs a DIVORCE... Well its the weekend and Monday is another day and I am sure another story..... --74.166.x.xx

Sometimes, the attorney is real. My only deadbeat tenant ever managed to talk his former (several years back) bankruptcy attorney into calling and hassling me when I was trying to collect rent from him, and afterward, when the eviction suit was active.

I still got him out. The attorney was merely able to prevent me from contacting said deadbeat (you cannot contact a represented person, especially if you are an attorney yourself). He didn't manage to string it out, but I guess it was good in the long run, as he knew deadbeat couldn't stay and encouraged him to just get out. He even left the place clean, knowing I would go after him for damages. So I didn't have to follow through on the eviction after all. --65.54.xx.xx

Hi Team...guess who called me 16 minutes ago??? Yep..you are right again, the wife. She asked me if I would accept less than 1/2 of the rent..I replied "You got to be kidding Me?" She asked, does that mean yes...I could not resist to say HELL NO....I am now wondering if some of these tenants are Brain Damage or Dead, she said please 3 times and I said NO 4 ....I am now actually enjoying this >>>>>> Never knew I could really Dissapoint someone (It actually felt Good).......Oh by the way..the Loud mouth Husband is still "Quite as a Mouse" --74.166.x.xx
