Dont know about GA but our tenny liberal loving commisioners in Milwaukee say I dont care what your lease says a 30 day notice is all the tenny needs to give.

If you move out and LL rents out your unit he cannot charge double rent and come after you.

If you lose your job and have to move out of state do you think the court system anywhere is going to make you pay the idiot LL that didn't re=rent his unit?

Bottom line is if Seemba knows one of his deadbeats is moving, Seemba sets up another one to move in.

When you have a lease, it's pretty standard to ask the tenant for two month's written notice that they will not be renewing.

Did you receive a renewal notice via certified mail and have to sign for it? Or did you not bother to go to the post office to pick it up.

Tell them what your problem is and see what they say. If your apt. is not too messed up and they can rent it right away they might let you off. Clean until your arms hurt. --76.99.xxx.xx

In Illinois you have to give 60 day notice if you are not going to renew.

Michael think of it this way. Would you want the landlord to come up to you and say your lease is up, get out tomorrow? No?

I bet your lease says that it renews and becomes a MTM agreement unless you give proper notice that you don't want to renew. No, they cannot make you stay until December 4th, however, they can charge you for rent until then or until they re-rent it, whichever comes first.

So, your best course of action is to do whatever they ask of you to make your apartment ready for a new tenant. In other words, tell the LL that they can start showing the apartment whenever they want to prospective tenants. So that someone will want to rent it, make it look really nice. And talk really nice about the apartment and your landlord when someone comes to look at it. That way, it'll rent BEFORE December 4th and your LL won't be able to charge you the extra rent.

That said, your LL has an obligation to try to re-rent it. That means he or she has to make the effort, advertise it, etc. to try to get a new tenant to replace you. Focus all or your attention of helping your landlord find a new tenant by making your place VERY appealing. --96.42.xx.xx

ALSO, I READ THE STATE LAW AND IT STATES CLEARLY THAT THE TENANT ONLY HAS A MINIMUM OF 30 DAYS TO NOTIFY THE COMPLEX OF PLANS TO RENEW OR LEAVE AND THE LANDLORD HAS 60 IF FOR CHANGES TO THE LEASE AND/OR TO ASK IF THE TENANT PLANS OR RENEWING. Remember that notification of 30 or 60 days runs with the rental period so if you notified they now you are still responsible for all of Nov in most states. If your rent is due on the 4th and you did not notify them prior to the 4th that is why you are responsible until Dec 4th --64.218.xx.xx
