I suspect the tenant is smoking marijuana, but I cannot prove it. Is there a way to find out? If he is proven to take marijuana, can he be evicted? Would landlord be liable to anything if tenant is smoking marijuana in the rental unit? --76.93.xxx.xxx

You sound more like a tenant whose landlord suspects him of smoking dope in the apartment but hasn't been able to prove it as of yet.

In any case, the following question would aply to anyone (landlord or tenant) asking the question about being able to evict over something like this:

What does the rental contract say about unlawful activity?

If *I* suspected illegal activity going on in one of my apartments, I'd go out of my way to surprise the tenant by popping by unannounced to check on something. If illegal activity was confirmed, or if the tenant acted nervous and refused to let me enter, I'd end the tenancy with no further questions and find a new tenant. --72.93.xxx.xx

Suspecting them of smoking it, and proving it are 2 different things. If you have a M2M, you can give them notice to move. If you think it's a problem, you can call the police, tell them you can smell it. They might be able to go in and search the property and if they find something the renter will be in trouble. I have had tennants in the past that I suspected were smoking pot. My experience has been that suspicion and proof are miles apart.

The local police are only concerned about dealers, they will only act if you provide hard evidence that large scale dealing is going on. According to a cop friend of mine the police view recreational pot use in the same light as underage drinking.

I'm a landlord not the lifesyle police. I don't get involved in other tennant issues like underage drinking, shacking up, adultery, etc. I finally resolved the issue on the basis that if the tennant pays the rent and takes care of the shack I'm not going to get excited about smoking weed even though I don't smoke. --199.20.x.x

I agree with Chris, don't worry about it. Tenant could also be taking illegal prescription pills, viewing bad things on the internet, bringing call girls home, etc. There are some things you can't control.

I agree with Dave. As long as I don't smell it, and the other residents don't complain, and they aren't dealing, I don't really care. I had a dealer boy once that decided to get high with all his buddies while I was working in the next apartment, three walls & a room away. When I started getting a buzz from the second-hand smoke, I knocked to let them know that they needed to put it out. (Didn't know he was dealing at the time.) They never answered the door - the fools. So I called the cops. While the cops waited for a dog & the search warrant, Dealer-Boy flushed his whole stash. The cops found seeds still swirling in the toilet. The cops & I told him he was no longer welcome in the property, and he was moved out that day by his daddy while the cops watched. The cops told him that because he had flushed his whole stash, they would consider it penalty enough for that day, and they would be keeping a strict eye on him in the future.

On a side note, his daddy didn't believe either the cops or us that he was dealing, until he went in & saw the seeds. Then he got kind of a funny look in his eye & dragged his boy off at top speed! --76.251.xxx.xxx

Many times pot users are also into other drugs when they can get it. To me, seeing a person smoking pot is just as bad as seeing them smoking crack and I would not stand for it. However as stated by others suspicion and real hard-core proof are two different stories.

The funny thing about CA is the laws about smoking (tobacco) and pot. They're doing everything they can to ban tobacco and everything they can to legalize pot?!? This would benefit me as a LL because my SFH lease specifically says no smoking (and no one questions it because CA is so "anti-tobacco". So if they smoke ANYTHING (in my house), and I find out, they're out.
