State Specific Question About: ARIZONA (AZ)

I have a rental property that has a min house and a guesthouse. both are rented. The agreement was for the tenants in the main house to pay all the utlities for the main and the guesthouse(it is in the lease. I just found out the water is to be shut off on Monday. She is leaving the end on Oct. I don't want to turn on the water for her. The person in the guesthouse had been made aware of this. They understand and will use bottled water from me until she is gone. They have another place for showers.

What is my recourse? I have served the 5day notice on the 2nd. --72.200.xxx.xxx

The person in the Main House has not paid rent. The person in the guesthouse has paid .

the lease on the main house ends Oct 31. They wanted to used the security deposit as last months rent. I said NO. it is spelled out in the lease sec dep is NOT rent and cannot be used for rent. The person in the main house ask me to put water in my name as they didn't have $ for Sec Dep and Rent on the new place and their utl. I am not putting the water in my name as long as they are there.

My problem is the person in the guesthouse will be the one to suffer. --72.200.xxx.xxx

Start eviction NOW!! Get it, NOW!

You will have to abate rent for the back house until it has water again.. What is that going to cost daily?

What happens when the back house gets fed up and calls the health department and building department?

Start eviction now, and keep water on for the back tenant.

I have served the 5 day notice on the 2nd. My rents are due on the 1st and no grace period. late on the 2nd.

I guess I'll just have to wait for the 7th and go to court to get the evection started.

I have already told the guesthouse no rent until he get water.

Can I shut off the water (per the shut off valve) to the main house and just have water in the guesthouse?

So, the person in the guest house who is current on rent will use your bottle water. Are you going to pour 100 bottles of bottle water through a shower head when the tenant showers on a daily basis? I bet each toilet flush will cost you $5 in bottle water too.

It's NOT practical.

No you can not shut off the water to the main house.

I think it's time YOU hire a lawyer that specializes in evictions and take a backseat before you get sued.

Judy,

Listen to us. Ultimately when a tenant does not perform according to the lease, you will have to fix the problem yourself and charge them. You are inconveniencing the back tenant for NO reason. Not having water on is unacceptable no matter what the lease says. You MUST get the water turned on ASAP. You are making a very unintelligent mistake here and drawing a line in the sand is follish. Tell your back tenant that you will have the water on by monday morning if you cannot do it by tomorrow. This is your lesson, never let a tenant pay the water bill. No I didn't mean to Yell at anyone. all the help is very much appreciated.

In Az the City isn't involved only the water company. The water is not in my name and I have no responsablity for the current bill.

I do not have to supply the main house with water. All the ultitiles are in the tenants name not mine. I can just have it turn on for the guesthouse, which I will do on Mon.

If they get turned off it is due from tenants non-payment. --72.200.xxx.xxx

You have a legal obligation to provide a HABITABLE unit for the guesthouse tenant. That includes running water and hot water as well.

You'd best have the water put in your name ASAP....then build the cost into the rent for the new main house tenant.

It is not fair anyway for the main house to pay for usage from other tenants in the other spaces anyway.

I'm not worried about the guesthouse I'll abate the rent and put them in a hotel/motel. I will not pay for the main house water. I should pay the water while they live rent free? --72.200.xxx.xxx

It’s obvious that you have an illegal rental, it will come back to bite you again and again with the arraignment you are trying to implement, any decent tenant in the main house is going to balk at having to pay all the utilities for the back rental, so no limit on the electric bill?

You may not be responsible for water to the main house but you most certainly ARE responsible for water to the guest house and must provide it before the city shuts you down for having a non-habitable rental property.

This is a habitability issue. Get the eviction going NOW with a good lawyer and get that person out. Get the water on NOW in your name and never let the tenant take it over again. Simply add the water bill fee to his rent since you have this crazy situation.

Why are the utilities joined for these two? Is that even legal to rent that way in your jurisdiction? --65.54.xxx.xx

Yes, it is legal.

1. I have moved the g/h tenant to another unit at my expense. that problem GONE.

2. I have no obligation to provide water for the main house. Although I would had they paid the rent.
