State Specific Question About: ARIZONA (AZ)

Tenants had a 1 year lease. They were only there for 2 months and left. How much are they liable for and do I return their security deposit.

Most states make them liable for the remainder of the lease term, reasonable cleaning and advertizing costs. However, it is up to you to mitigate the damages (i.e. attempt to re-rent ASAP). What did it say in your lease about notice to quit? Most states require 30 days written notice. The tenant has to pay for the subsequent 30 days after the notice.

If they did not give notice, you can keep one months rent from the security deposit for them not giving 30 days notice. Plus, you also deduct damages from the security deposit.

After all this, you have an obligation to mitigate your loss. Meaning you have to try to find new tenants. If you can't find new tenants, you can take the old tenant to court and sue them for breaking the lease. You can try and get the whole year's rent, but most courts will only award you a month or two of rent (against the old tenant.

Pretty much what the others said. You need to try to re-rent, they are responsible up until the point that you are able to re-rent, cost of advertising, and of course cleaning and damages. Good luck collecting though! --167.6.xxx.xx
