State Specific Question About: WASHINGTON (WA)

All right LL's, I am new to this site, and I am a LL with mortgages and bills to pay. I have been reading and it appears to me that there are a few cocky LL that appear to act like their GOD's. It appears that Evict, evict, evict is the solution to everything.

Now, I know that there are a few - no a lot of high maintenance, troublesome residents out there, but I tolerate it and take on some risky tenants because I am investing for my retirement by provided medium to medium high-end rentals.

Ask your self the following;

1. Why are you in the rental bussness?

2. Who pays your mortgage?

3. Who is giving you equity on your property?

4. Who will benefit from the property you own in the end?

Within reason, don't be so tight with your residents let them live if they are not selling drugs, trashing the place, violated major clauses in your rental agreement such as smoking and pets.

High maintenance, troublesome tenants know that there will always be LLs who'll rent to, and tolerate, them. If you're comfortable contributing to the problem by letting things slide and turning a blind eye in order to stay full, have at it; just don't wag your finger at others who choose to run a tighter ship.

I am only a small time guy with a (VERY) few units. You lost credibility with me when you wrote a troll post on Sep 22. The IP address shows it very clearly.

See the post called "eviction" on Sep 22, 2008 11:25 PM, if there's any questions.

No offense intended, and I don't know your motives - but you have shown that you are not who you say you are. No cred from me until you come clean.

When you are prepared to come here and discuss things and show your true colors, then we can talk. I for one will always try to find the best tenants I can. My market isn't the best in the world - but I'm entrusting them with a lot of my money, in the form of an asset that they can easily screw up! I believe in treating people well at all times. As you point out, my renters do a lot of good for me. Likewise I do a lot of good for them. I am honest with them, and request that they be honest with me.

Now - when you are prepared to be honest with us, we can discuss further. If you own rentals, then by all means run your business the way you see fit. I run mine the way I see fit, and the suggestions in this forum have helped me immensely. In return, I try to help others. My way isn't the only way, nor is it necessarily the best. Just sharing what works.

Your last posted quetion, you were a tenant, and you had someone move into your unit without asking your LL and without putting them on your lease. That, "Don", IS violating a major clause in my lease. My rental is a business and I run it as such. I am the one that pays the mortgage, and I'm the one that works my butt off for it, along with working a full time job. Stop wasting our time because someone chewed you out in your last post for posting as a tenant and not a LL. On medium/higher end rentals, I rarely have the drama and tenant behavior issues. My plan is still to weed out the problem properties and scale upward. If you are a LL and you have a full time job, you probably dont have the time to spare on tenant drama --68.92.xxx.xxx

First, I am not a troll. I have a problem and wanted to know what others had to say about unauthorized guest.

First, automatically reject applicants if they

1. False or misleading information provided on the Criteria Interview Factors or Rental Application.

2. Rental history at which confirms any unpaid collections or balance due to a Property Management or Landlord.

3.

Rental history at which confirms a filed Unlawful Detainer within five (5) years.

4.

Rental history at which confirms complaints and or disturbance.

5.

Any criminal offense that took place within three (3) years of application date. (minor traffic violations not included)

6.

Any drug related criminal offense.

7.

Any criminal offense of a physical or violent nature against another person or property.

8. Any conviction of a felony.

9.

Sexual offenders.

When, I ACCEPT high risk Tenants deposit does increase to protect my self, and I do convey to the applicants from the start. If they do not like they move on. Of course, applicants MUST have good reference.

Another example: If a new tenant lies about being a smoker or have pets, they do not last long, I do evict straight up - no questions asked.

One more example: Vehicles, I let the tenants them selves work out the issues about if parking in each other spots.

if a resident cal me about someone in their parking spot, I assume they have tried to locate owner and failed. I call the towing company and remove the vehicle. I stooped getting parking complaints and now the tenants now talk to each other when they have there get-to-thers.

Back to the "eviction" mention earlier. Tenant passed application process and met the qualification to be the sole responsible leas holder. The two other guest completed applications and pass as well. One moved in did not complete application sent notice to comply but left out the vacate portion of the notice. I did a back ground check from car plates and no eviction or criminal history and does not owe another landlord any money. (NOTE: If I found any of the above - I evict straight up. No holding back. I give the resident the option to remove that guest, or I am in ex partie court with a summons and complaint to be served. Once served the guest is out and we move along as if nothing has happened - with the exception their next payment to me is higher because of the extra charges. My property is not a safe haven for those kind of guest.)

My main objective is to have paying residents that are not trashing the unit, police there for crimes know bad stuff and staying long term. As for the guest, non compliance, the trust and benefit of the doubt is lost for now.

I use evictions as a last resort but proceed with times line as stated for non-payment of rent.

See the copy below...at the very least you've got a weird situation going on, and we tend to be leary of weirdness unless there's a good explanation. So what's your story Solidoak/FULL/tenant/landland/??? ?

I am a tenant and my landlord is wanting to evict me because, I have friends living with me. I pay my rent with no problems and a good tenant. They do not cause problems and keep the yard mowed and clear of garbage. They do no want to fill out an application because that will lower their credit score and they hope not to be living there too long.

My friends need help until they find a place to live as no one will rent to them as their credit is bad but they pay rent on time and take care of the place.

one comment on the increased deposit in order to accept an application - I would do this only if they were short on income. I would not do it if they had felonies, evictions and past bahavior issues. tenant history will repeat --68.92.xxx.xxx

I'll take your word for it that you are a LL. It looks to me like you posted as FULL(CA) to make a point/put things out from a different angle. I'll also guess that you know now that that is not normal behavior around here. (grin) Hopefully, you can see why we are suspicious of people that do not seem to be "themselves". Please understand that I meant no ill will - things just didn't add up!

Given that you are legit, here's my take on your post:

I agree with you. It seems like you're on target. I agree with Mike as well - no extra deposit for criminal background, etc. That's just a go/no go decision. Since we don't have "source of income" laws yet in IN, I tend to frown on some professions as well. (cough)lawyers(cough)... (evil grin).

Don/Solid-whoever, In answer to your orig post above about how tenents help the LL:

-it is BECAUSE you are a NEW LL that you don't know that many of your premisses are wrong.

-it is BECAUSE you are a NEW LL that you feel our tenant views come accross as extreme.

-it is BECAUSE you have not YET run into most of the tenant issues that WILL EVENTUALLY hit you, that you see tenants positively. You have not yet suffered their abuse, and had your property suffer their abuse--YET.

-the LLs on this board seem cocky to you?? Cocky is a new LL having the gaul to instruct LONGTIME LLs on their attitude--that's cocky!

-come back here 5 years from now, after you have been dragged thru court, had your property distroyed, had tenants call the City and Health Dept on you, found your clean units infested, suffered months of non-payment, had the police repeatedly at your property, had your property labeled as a drug location, etc. Come back and use the same pro-tenant list you have above--and see the difference. But long before then, you will have become one of US--people who have seen it all and know EXACTLY what they are talking about.

Solid, You come here and tell us you are a new LL. OK, I'll believe you. You make a list of good things that tenants do for the LL, and use it as justification to tell us that we are too hard on tenants who do so much for us. OK, I understand your position because I was a new LL once and I had the same feelings toward tenants. Then reality happens, and it changes your point of view. Slowly your pro-tenant list will melt/evaporate as you are on the RECEIVING end of the actions of these wonderful tenants. Pretty soon, if you stay a LL and stay here and be part of the board, you will be the one telling new LLs about your experiences and giving warnings to them on how to operate--examples from your reality.

You used the word cocky--you saw it in others, but not in yourself.

Please de-code your last sentence. What is a "sepal;" what does "sew it back on" mean. Likely derogatory.

Eventually you'll probably be a great LL. You'll have your own style of LLing and it will work for you as well as others works for them. You've already made 2 positive steps--you've bought rental property, and you've come to this board. Take from it what you can, what you need, and let the rest just roll off you.

I do not accept just anyone as it might appear, not like I use to. I do have a critera and it is strict.

Another thing, if one of your past tenant's came to me and they owed you just even one dollar - they will be rejected out right until there is proof from the past you the debt was paid. A lot of LL here in Kitsap County and Seattle have been paid or satisfied because of my policy

I do evict if I find out there is a unauthorized tenant living in one of our unit and owes another LL or has been evicted. My last eviction was exactly this case. --67.183.xxx.xxx
