I need to know at what point can I evict. Is it legal for me to evict a tenant for numerous late payments? --69.148.xxx.xxx

You can begin eviction proceedings the day a tenant is late with rent. File a landlord's petition at your courthouse. However, with this form of eviction, the tenant can stay (cancel) the potential eviction by paying what she owes, including during the trial.

Is the tenant on a lease or a monthly rental agreement? --64.12.xxx.xxx

If the tenant is on a monthly rental agreement, you can simply terminate the agreement with a notice of at least a month, ending on the last day of the rent period. In other words, if the tenant's rent period begins on the first of the month, anytime between now and the end of September you can give a notice of termination effective at midnight on the last day of October. However, it the tenant doesn't move out voluntarily, then you need to file an Unlawful Detainer, more complicated than the Landlord's Petition I mentioned in my previous comment. --64.12.xxx.xxx

Just as Carolyn said, you can file the eviction on the 2nd (assuming rent due on the 1st).

Tenant can walk into court with the money and stay, or pay anytime before that, of course. --68.92.xxx.xxx
