State Specific Question About: CONNECTICUT (CT)

My lease states that they will be charged a late fee, $45.00, after 3 days late, it is now 5 days.

They do not want to pay the late charge, but have the rent, with out late fee, ready. This is there first full month,

They said they called the housing and housing said I can not charge a late fee? what should I do about the late charges?

First of all, I have no idea how CT works. Them telling you they called housing, and that actually being a "rule", are two totally different things. If there is a housing authority that you have to answer to, then YOU need to call them. --66.17.xxx.xx

Are they Sec 8, or government assistance? If they aren't, what does housing have to do with your late fee? Unless CT does not allow late fees by law (if so, it should be taken out of your lease), rent goes towards late fees first, at that point they are still behind.

Have you checked around to see if $45 is the normal late fee charge. You can call around to other apartment complexes and see what their policies are on late fees. --167.6.xxx.xx

I did find that your late charges for CT are maxed out that 5% of the rent. So, your rent would have to be $900 or more to charge $45. If you are Ok on that, I'm thinking they are making up the story about what housing told them. --167.6.xxx.xx

Serve notice and evict. This is their first full month and they are already putting the screws to you. You cannot evict these people fast enough. Please save yourself 11 months of insanity, sniveling excuses, late fees, disrespect, and trashing of your property and evict today. Do not stop, do not pass go, do not collect $200 (but do take the rent money and apply to late fee first then rent).

Sorry to be so blunt but these are your two choices. You have "professional tenants" on your hands who are already sponging off the taxpayers and know exactly how long it will take you to evict them. They will continue acting like idiots until you slap them upside the head with and eviction notice. While this MIGHT set them straight, I sincerely doubt it. They are players, gamers, disrespectful, and liars. Yes I can call them all of those things without a twinge of guilt because of what you've told me already. If they are still around next month, it'll be interesting to see how late they pay when they know you don't evict for backing down on your late fees. Or IF they pay...again, they probably know exactly how many days it takes you to evict. Free rent until then!

I agree with Sid, but if you are not doing what you need to within legal means, the judge will laugh at you when you go to court. If you are, than go get em', take the rent, and tell them that they are $45 short on rent now, follow up with pay or quit and follow through with the eviction. --167.6.xxx.xx

Not on Sec 8 then who is the housing they called? Take the money and give them a receipt saying they are $45 behind due to late fees and you will be starting eviction, they can ad the court cost to the amount after they are served papers. Hate to tell you, but the tenants are right.

CT laws allows tenant until the 10th to pay rent. It cannot be considered late until the 11th of the month. After that you can impose a late fee of not more than 5% of the rental amount. Check the state landlord/tenant laws. Is this your first time as a CT landlord? Make sure that you also send them interest on their security each year. The state actually tells you what percent you need to give them. It has been 1 1/2 percent for the past few years. Again, I suggest you either join a Landlords association to learn the laws or just read them. Not knowing them will cost you dearly. --68.9.xxx.xxx

Hopefully it will let me post on here. The site is thelpa dot com. They have leases that are within the law, and are LL friendly. Though you cannot download the whole, there is a fee.

You also want to check with the lawyer how many days you have to wait to file the notice to quit. I'm not 100% sure, but it might be 9 days. Hopefully a lawyer will be able to give you some more insight on this. --167.6.xxx.xx

When you able charge the late fee--9-10 days after the first, whenever) take what they give you, then send them an "accounting for the month of Sep 08." This acctg shd state that all fees and charges owing are subtracted FIRST, and all remaining monies go toward monthly rent. so:

$1075+$45 late fee=$1120 due on 10 Sep. Paid on 10 Sep $1075; minus late fee=$1030

$1030 was applied to Sep rent

Sandy, your lease needs to be revised. You late fee clause is illegal in Connecticut.

You cannot charge a late fee until the 11th in Connecticut, housing is right.

The tenant has 9 daysd AFTER the due date in which to pay without penalty.

If rent is due on the first, you can't impose a late fee or serve a Notice to Quit until the 11th.
