State Specific Question About: NORTH CAROLINA (NC)
I have a tenant that that entered into a 1 year lease in May 2008. In August he moved out. On Aug 12 had the electricity and water tuned off. There was a civil matter that took place at the property on Aug 29, 2008 in which he told the Police officer that he had no intention of returning to the rental property. This statement will be in the officer's report. His rent is paid up for Aug 2008.
My question: do I have to still serve him with the 10 day notice for eviction or can I file abandonment charges on September 2, 2008?

Do you have the keys? If you do, that would be good indication that tenant has left for good.
Otherwise....it would probably make good sense to file for eviction.

do u have the keys ?can u get the keys?i would call him at the regular number .if u cant get him write him at his last address.and or contact his emergency contact.it might even be worth while to pay him a few bucks to close the thing if he seems unwilling to give u keys.once u have keys he is gone. --208.58.x.xx |

I do not have the keys. But there was another incident at the property on Friday,where the Police where called out and he told the Police that he had no intention of returning to the property. Also in a previous Aug 9, 08 police involvement he told the police that he was in the process of moving back to Asheboro. --71.71.x.xxx |

If there was an incident at the property on Friday, August 29, and the police spoke to him at the property on Friday, August 29, then it seems to me that he was at the property on Friday, August 29, and that he had NOT abandoned it as of Friday, August 29, despite the utility turn-off.
Give the 10 day notice or whatever it is you need under your state's laws.
