State Specific Question About: WEST VIRGINIA (WV)
Should a landlord forget to have tenant renew a lease and the tenant continues to occupy the unit several months after the prior lease date expired does the law recognize an assumed month to month or must there have been a new lease signed as soon as the first one expired? --75.108.xx.xxx |

Can't help you with W. Va. statutes. My lease covers this issue.

Not positive about WV, but usually it assumes to a M2M...or, I know in MI it assumes the original term (ie, 1 year lease is signed, and when it expires, another 1 year is assumed). You could always give an attorney a call and see what they say. --167.6.xxx.xx |

What does the lease say? MIne indicates that it reverts to a MTM after term expires. --76.97.x.xxx |
