If a tenant does not pay the month's rent because you are not renewing their lease at the end of the month, do you have to give them a 30 day notice to move out. Or legally can you make them move the end of that month. --66.142.xxx.xx

NO, not till after they were 30 days late

AGAIN, did I call her and tell her-she than said she would mail the aug. rent (which we have still not received) and she said that legally we had to give her the 30 days-even if they haven't paid?

My husband is one of these that don't want to put any one out-but we will be 2 months rent out if we give them until end of Sept. --66.142.xxx.xx

So, you gave her notice and she hasn't paid July and August rent? You should have already started the process, but you can still do it. You didn't need to give her a 30 days notice for late payment. MO's notice for pay or quit is immediately, go post one today! Make sure you have a witness of posting it, or video tape it. It sounds like your tenant is trying to be the boss, she is not. It sounds like you don't know what to do, go talk to an eviction lawyer. --167.6.xxx.xx

Lois, begin eviction today. Your tenant is playing lawyer with you. She doesn't know a hill of beans about what is legal or not legal. You are going to get the screws put to you unless you act firmly, fairly, and TODAY. Buy your husband a steak dinner with the money you'll save by not waiting for any more crud from this deadbeat tenant. Evicting deadbeat tenants is part of the LL buz. You can't ever make them move. When they fail to pay rent or fail to move when you have told them, you go to court and basically ask the judge for permission to hire a sheriff or constable to toss them out. Non payment is pretty straightforward, they can't stay if they don't pay. No fault termination can vary from state to state. Go with non-payment if you can. --192.234.xxx.xxx

Lois, I'm also guessing that you haven't done an eviction recently (or maybe never). While your tenant should move out at the end of the month, there is no guarantee she will. Even though your lease says your lease is over as of such-and-such date, the tenant can stay put if they're feeling nasty. This is called a hold-over. Now the law says you can charge extra rent (double, I believe), but if your tenant is a non-payer, double rent means nothing unless she is collectible. Also, you still have to go through the court process. You cannot change locks the day her lease ends. It'd be nice if you could, but you'll get in big trouble. Don't disconnect utilities or try to intimidate her out. You just need to file for eviction based on non-payment. This can take 3 - 4 weeks to get a court date and then another 1 - 2 weeks before the sheriff will actually show up and help you toss her stuff to the curb. That's why you need to act TODAY to get the ball rolling. Good luck. --204.80.xxx.xx

I sent these e-mails to my husbands e-mail at home and when I saw him at noon he said he sent a ceritfied letter to the tennant stating since we did not receive Aug. Rent we expected her to be out by Sept.1 BOLD MOVE huh? this is our first eviction and this is the story. We live in Kansas and have several rentals in Manhattan, Ks. We purchased this home in Lees Summit from our son when he moved into a bigger house to help him out. So we are 2 hours from there and what should our next step be. I printed out a form "A Landlord's Ptettition" which says we need a lawyer since we are a LLC. Is there another form I should be using, what are your thoughts, please. My husband is semi retired so he can run down there during the week, we want to do this right because I have this strange feeling she will not be out on Sept. 1st. --66.142.xxx.xx

If the property is owned by an LLC, then you must use an attorney to represent it.

The certified letter is not a BOLD MOVE. It is not required in MO. Why are you waiting to file the eviction? Don't wait until the end of the month--it will take weeks before the tenants are even served, so they needn't know you didn't wait. --64.151.xx.xxx
