State Specific Question About: IOWA (IA)

We have a tenant that has given 30 days notice that she is moving out. We would like to show the apartment to possible new tenants and she is refusing to grant us entry. She doesn't think that she has to let us in unless it is for inspection or emergency purposes. What are our rights to enter? --12.206.xx.xx

Hi Jen..

Just so it is said to you..

be sure and check your state statutes

they will tell you the procedure for gaining access and posting notice or what kind of notice is correct...

Maybe take a witness to the showing..

Me I have a small vidieo cam.. works on a chip not a disc.. start the cam as you get out of the car,go to the front door pic yourself posting the notice..

also vidieo all the conversations..

I just let the camera hang around my neck as it is really small.. so usually all you get is the voices.. once your inside..

If your lease and state statutes allow you to show the unit to prospective tenants after current tenant gives official notice of vacating, I would document the tenants refusal to comply. CAn you find a way to do it--sure if you "reach" far enough. SHOULD you be doing it--NO!

I would never try to show a property till it was vacated, cleaned, repaired and ready to view. New prospects are going to see the present tenant's mess, clutter, bad taste in furniture, poor housekeepping, and possible even pest problems. They WILL associate what they see with your unit. It is only human nature!

You will want them to see how clean it will be once you have cleaned it! You will want them to see how much space there is. You will want them to visualize THEIR stuff in the place. They can't do that with her stuff in the place. ESPECIALLY with a non-cooperative tenant! What are you thinking? The prospects will be polite but walk away thinking -- no way would I live in a place like that!

Don't force this issue. It will do more harm than good. She does have certain privacy rights as long as she is paying the rent and following the rules(proper notification). She will make this showing hard and the one who will suffer is you. Chill out. Let her GO. Fix and clean after her. Show when the place is at its BEST--not its worst. --140.140.xx.x

Sometimes it is difficult for landlords to show units to perspective tenants....However, you have a plus on your side....the tenant is moving....Iam glad you dont have to sell the unit...By the time you get throught fussing and fighting for them to open the door...30 days will be here and gone...
