State Specific Question About: WASHINGTON (WA)
My new tenant is a boor. At two months into the lease he has been late twice. I've been read the riot act by him and he's demanded that I send all communications by mail and that I "prove" he got it. He says email is not written notice! I sent certified letters about the late fees and he has refused to sign for the letters. Communication is impossible. I've written, although he hasn't read, that I've taken the fees out of the security deposit and he must make the deposit whole again. Obviously, that is not going to happen because he's got his head in the sand. His credit was so bad I got double the usual security deposit and it looks like he's going to use it up this way. Not sure about WAS state laws, but in Maryland, we can file in LL-Tenant court for both late rent and/or unpaid late fees...so check out your local laws.
Update your lease for the next tenant to state that rent payments first go toward any unpaid late fees & utilities, and remainder will be applied toward the rent...i.e. if not paid in full, you can take them to court for incomplete rent payment, and not wait to deduct from the security deposit at end of tenancy.

Send two copies - one certified, and one regular. When the certified comes back to you, leave it unopened. This is your proof to the court that you did serve notice.
I would not cut this person one inch of slack, and we would be on the "eviction train" forthwith.
If you do not know how to get rid of this deadbeat, find your local lawyer who does evictions. Do it before you use up that deposit on late fees.
Trust me - this situation is not going to get better.

In MA we would not be able to use the SD to pay for late fees if the tenant was still in the unit.
Does your rental agreement spell out how monies received are applied?

I would have started eviction as soon as he refused the first late fee and he told you he would be a problem.

Being a state specific question bout WA, you should learn the eviction process for WA and use it ASAP. BTW, you should not have to use certified mail. Regular mail and posting at the premises is enough. I've read a few posts here lately with LL's communicating by email. I wouldn't. --66.32.xxx.x |

Thank you all. I am waiting for the letters to come back to me (15 days from sending my postal carrier told me) and I have contacted an attorney, but I haven't heard back from him. The amazing thing is that I was at his door hoping to measure the space for a new refrigerator for him and his family. He went nuts and said he didn't care. His wife looks like she gets beaten. And here's the really amazing part; he has a great new job with Microsoft, so he's able to pay and on time! --76.121.x.xxx |

I never email and I never mail notices except where required. Here, mailing s l o w s the process down to a crawl. I either hand them the pay or quit or post it on the door. Also, IMHO each time you deduct anything from the deposit, you little by little lessen his interest in performing to the perameters of the lease.
What I do is once late fees go unpaid is start sending bills showing the remaining balance each month (not rent, only late fees). This makes the balance real and business like. And builds a case to deduct from SD if necessary at lease end.
But before that, once I have an issue, they get the pay or quit by the 3rd. And 2nd, if they keeping pushing. Eventually they'll go beyond the 3 day and get the lease end letter. --24.99.xxx.xxx |
