After tenant has become a habit of not pay rent on time as stated on the lease (payment has to be paid by the first of each month if not 10% late fee if not receive by the fifth)?
We ended up call them requested payment each month as a matter of fact this month after the fifth all we received from them was only half rent paid $400 instead of full amount of $675...we been wait for other half payment up to today August 14 still not receive other half yet....after conversation with her yesterday; she told us that she willing to pay the rest of the rent by next Tuesday in full (late fee and court fee)
Please advised me what should we do with this type of situation? Should we continue to work with them or give them time to find some where else to move; relistically I told her that I will give them 3 months if they continue to violated the lease to find some where else to move in?
PS. on the contract sing only mother and 4 children and ended up 3 adults with incomes move in. Mother whom sign application has two income from her job and her husband pention her credit was good; daughter who sign the lease and her husband collect disability check and 3 children which more people move in that original agreement? Please advised me if as she said that she will pay in full the rest of the rent by next week? Should I continue to have them stay and drop the charge? In fact I told them that I will give them 3 moths if they continue not pay on time to move out?

Get control of your rental.
Start over, send them a non-pay notice per SC court requirement. Your only concern is sending them legal notices to start eviction. These folks know the routine and expect as much when not paying. They have discovered you are not acting in your behalf and so slip sliding as long as possible. Don't worry so much about communication. Don't over think as the legal notice tells the story.....end of discussion. Be professional, meaning don't communicate to them concern as that displays weakness. Send them a notice and since a novice, the best advice would be have a Lawyer send as that communicates hardball no nonsense....end of gravy train and high cost/risk to dead beats. --67.150.xx.xx |

Vera,
You need a specific paragraph in your lease with exact wording from the SC LL/tenant laws. If you have that paragraph, no 5 day notice is required. On the 6th of the month, go to the magistrate's office and file for eviction. In Sumter it costs $30 plus $10 for the sheriff to serve the papers. I pay an extra $25 and get a process server to do the job. He's faster and more reliable. The eviction notice gives em 10 days to pay or leave. At the end of that 10 days, you have to file again for EJECTION if they are still there. It only costs $10 more. The sheriff will then schedule a time in the next few days to supervise while you and your crew remove everything to the curb.
Don't waste any time with phone calls. Only what is on paper counts. Start the process as soon as possible. Make the tenant pay all the extra costs for eviction and ejection (it's legal).

Vera, welcome to this forum. These tenants had this planned. To rip you off by moving in more adults etc. I would suggest looking for a specialist law firm offering flat rate eviction services. They can serve the proper notice, too.

They are taking advantage of you.
Post a notice to pay or quit (they need to pay all rent and late fees in the number of days your state requres, or they have to move out).
Post a notice to comply or quit (only the person on the lease is supposed to be living there-they either need to be screened and added to the lease, or move out-or everyone needs to move out). --167.6.xxx.xx |

In SC does accepting rent in parts void the eviction like it does in CA or is it different?
If it cancels the eviction then you need to not accept payment of rent in parts.It's all or none by the due day.
