I have this clause in my lease and I don't quite understand it. Anyone have any ideas?

DUTY TO PAY RENT AFTER EVICTION OR SURRENDER

Rent is due under this Lease even if Tenant surrenders the Premises or is evicted by Landlord. Landlord shall make good faith efforts to mitigate damages.

Landlord shall make good faith efforts to mitigate damages. = If you evict you will try as hard as you can to get someone else to rent the place quickly, so the deadbeat doesn't owe another six month's worth of rent.

In some courts (such as mine), if you evict that is viewed as your terminating the lease so you can't collect under the choice "evicted by landlord."

Check to make sure that part is allowed in your state.

Also be sure you have a severability clause, that if a clause you have is in violation of the law, the rest of the lease still holds up. --205.188.xxx.x

That clause would not fly here, for exactly the reason Carolyn gave.

Thanks Martin and Carolyn. I think if I take the eviction part out it will make more sense.

If the tenant leaves of their own accord, they are still liable for the lease until it is rented.

You are trying to understand everything in your lease--BRAVO! Your lease will save you one of these days. If you amend it--just make sure that what you change is legal in your state.
