State Specific Question About: MISSOURI (MO)

I have tenant breaking the lease and I have them a 48 hour notice for someone looking at the house. They stated they didn't want anyone in the house while they weren't there. Is there a law regarding that? I believe that's reasonable enough time. --72.56.xx.xxx

As far as I know in CA you have given proper written notice. You have the right to show the property.

I have a clause built into my notice of receiving a tenants written intention to vacate the property notice several things. I make them aware that they can request a Pre move out inspection. A move out courtesy letter with what my cleaning requirements are. In the terminate tenancy if they use mine and also in my receiving that doc I restate that with 24 hours prior notice I reserve the right to show the unit to applicants and workman at all reasonable hours. When they sign there intention to move out letter it is dated. Stuff about their last months rent being due as a in part payment if they terminate at say the 14 of the month. That they agree to allow the unit to be shown. There forwarding addy.

I do open houses on the weekends and tell schedule people in groups as well as tell others there is a open house. Give the tenants 3 or 4 days notice. I don't want the current tenants around honestly.

Besides they broke the lease. The quicker you re-rent it the less they will be out of pocket for. Don't let them stick it to you for months with no rental income that the least term is still in effect. Adverstising etc.

You certainly have the right to show the property with adequate notice given ahead of time. Whether it is worth doing depends on how the current tenants keep the property. Missouri law doesn't address this. However, both parties should try to be reasonable about it.

Does the tenant understand he is liable for rent until you get it rented, since he is breaking the lease. Explain this, and then very nicely tell him that the two of you can work together to find another tenant so that he won't continue to be responsible for the rent for a long time. But, to do that, you need to be able to show the place. You will always be with the person looking.

And then I would proceed to do it on 24 hours notice, trying if possible to have the time fit appropriately with the tenant's schedule.

I have a standard Move Out letter for both lease breaks and end of leases...

The 1st paragraph says...

In order for you to receive the maximum return of your security deposit...you will need to keep the rental in excellent showing condition when we show to new applicants...

Also...this is to give notice to you that we will be showing the unit on M-W-F between 10 AM-4Pm without notice to you...anything outside those times will will call you to arrange a convienet time to you...

The bottom line on your post...You are the LL and you ae in Charge and the Tenant is not...so you have to muscle up and gingerly/politely tell the tenant to pound sand...however, if they want they can resist big time and either talk about that Bad LL to your applicants or take other actions of revenge...

So... the key is to convince the current tenant about how it is to their $$ advantage to allow you so show before they vacate...

Thanks everyone! This has been great advice. However my tenant is denying my property manager access to the house while they are not there. I travel between Kansas City, MO and Orlando, FL. I guess I'm going to see if I can sue for not letting them into the premise. --72.56.xx.xxx

I hope that was said out of frustration and wasn't a serious comment. What would you accomplish? What would you sue them for? What are your damages? Who would do your legal work?

Is your house actually in Kansas City? What part of town? What size? What rent?

My house is in Kansas City. 64138/Hickman Mills school district. Its 3 bdrms, 2 baths, 1 car garage, partial finished basement. I've been getting calls already. I'm definitely frustrated but I will be suing them for the remainder of the lease minus the months of getting a new tenant after I get someone else in there. --72.56.xx.xxx
