Missouri law doesn't address late fees, although you do need to have them described in your lease in order to collect them. Nothing is stated about the amount allowed. However, a very respected attorney who helped in the last revision of MO landlord-tenant laws refers to the "eyebrow" test. If a late fee is so high that the judge raises his/her eyebrows, then it is too high.
There is one judge in my county who would NEVER allow late fees, no matter what is agreed to in the lease. Another judge usually won't allow more than a month of late fees, since the judge's view is you could have evicted. --205.188.xxx.xxx |

Carolyn is right--it seems to be dependent on the judge. Our late fee is $5/day, and this has always been allowed. --64.151.xx.xxx |
