This is NOT a simple question, despite the stupid response by ManateeAlley. It is presence of the alien in the United States that is illegal, not your renting a house or apartment to the alien.

I am not aware of any legal obligation on my part to check the immigration status of an applicant. I am not aware of any system in place for me to easily verify the immigration status of an applicant.

To the best of my knowledge, there is no legal obligation for me to run a credit check. I would not know a "green card" if I tripped over one, although I do understand that they aren't even green anymore. I would not recognize a real tourist visa, as opposed to a forgery, if a purported tourist visa were shown to me. (I can legally rent a unit to a tourist, can't I? I know that I, as a tourist, rented a house in Spain once and a house in France once, and I don't think I was breaking any laws.)

So how can I be responsible for determining the immigration status?

That being said, I remember that within the last few months, there was a landlord who was charged with harboring fugatives or something like that for renting to illegal aliens. But I don't think the charges will stick, unless the landlord was actively seeking out and exploiting illegals.

Sean's citation refers to anyone who "encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law". Assuming none of us advertise in China or Mexico or England encouraging potential tenants to come rent from us, this wouldn't apply. Maybe the LL Mike referred to was seeking out illegals.

This is the other Brad in Indiana. 31 years as LL. If you are near Bartholomew County, we have a great LL Association!

We rent to many illegals. Have for years. Their money is actually more dependable than native Hoosiers. We have never taken one to court. Rarely late. Seldom complain.

Indiana has no law against renting to illegals immigrants. In fact, if you even ask, you can be sued for Fair Housing Laws violation.(even tho the guy cannot speak English)

Indiana's proposed laws limited "harboring, transporting", etc were voted down.

You could be sued for discrimination if you only ask hispanics for proof of citizenship. If you single out hispanics for special extra screening you are breaking federal law. So if you're going to ask for proof of citizenship you have to ask all your tenants for the same proof. --67.33.xxx.xx
