State Specific Question About: ARIZONA (AZ)

My wonderful PM (who has been fired) did not think it was important to tell me that the tenant never paid July's rent. Her reasoning was that it would take $200 to file eviction, while the tenant gave notice she would be out by July 28th (lease is up July 31). I appreciate her reasoning, but a heads up might have been "nice" to say the least. I can only hope she served her with a pay or quit notice, as was her job.

The tenant asked me for another six months on Monday and I told her it was too late b/c husband is coming out Friday to look at the house (which is all true). I'm just as glad to be rid of her, though.

If she doesn't pay July's rent, what is my recource? Should I speak to an attorney now, or later?

Here is the thing: the lease is up July 31st and I declined to let her renew. The EXPM did not think it made sense to start eviction since she has to be out in 30 days anyway. However, I'm trying to find out if EXPM served her with a pay or quit in July as she SHOULD HAVE. My attorney says I may be able to keep the security deposit in lieu of rent. Of course that won't help me much if she's trashed the place. --71.84.xx.x

If the lease expires July 31, the tenant must give 30-day notice July 1 that they intend to vacate.

She did give notice to vacate, on July 28th which is the reason the EXPM did not see reason to begin eviction when the July rent was not paid. When I talked to her, she was trying to say she had until August 1st (the lease ends July 31st) to get out. Suddenly she needed those few extra days. --71.84.xx.x
