It depends on the wording of your rental agreement. Also depends if you did a holding agreement. If the word deposit is used in a holding agreement instead of a holding fee, then yes you need to give the money back. This is a very general answer. We need more information as of the wording of the documents and whether you used a holding agreement or not. Which it sounds like you didn't.
Your rental agreement that was signed may have the language needed to make the tenant
responsible to cover some of your loses in this transaction.

If the lease is singed, it's binding.
I would not return anything for at least 30 days.
You will have to mitigate your damages by attempting to find a replacement tenant. Until a replacement is found the tenant is on the hook for the rent.
Once a replacement tenant is found and they have taken possession of the premises, deduct any rent owed per the lease from the rent/security, write a check for the difference and send off an accounting. --76.245.xx.xx |
