State Specific Question About: NORTH CAROLINA (NC)
Basic question (I think)
Have a tenant who 5 months into a one year lease say she needs to move out (sick mom excuse)
She is asking about the deposit ( which is 2 months rent).
If I get it rented quickly, I would be willing return the difference between what it cost me to get it rented, but if she moves out
can I change the locks??? Can I go in there and paint, etc, etc, while still keeping the deposit........the place is hers till the lease is up...

If you can rent it during that time, you cannot charge her for the time that someone else is living there. As soon as she turns over the keys you can change the locks, clean, paint whatever. You can keep a detailed list of what charges you have to keep part of the deposit. How long you can keep the deposit depends on the state maximum. --167.6.xxx.xx |

what she wants to hear is ...sure no problem go ahead and move and here is your deposit back.
I don't want say that, I want to protect myself from lost rent. I don't want to ask her to move out because then it looks
like I am breaking the lease.
they are not staying in the apt. and told me over the phone it is OK to show the apt. while their stuff is in there. They plan on getting it out by the 1st...

You don't need to ask her to move out, she already said she was. If it's not stipulated in your lease that you can show the unit while she is in there, don't do it. Tell her that the first step is that she turn over the key so you can have possession of the unit, then you can clean it up/paint/change locks, then you will do what you can to rent it out. At that point, you will send her a check for the rest of the security deposit along with a list if anything of why any of it was kept.
Tell her it's a standard for the state and that's what you are going to follow. --167.6.xxx.xx |

brenda is wrong. you do NOT send any part of the security deposit back yet just because tenant moved out and returned possesion.
you will do what you can to relet. until that time, your tenant is responsible for the rents, in full, each month. AFTER the property is re-rented, then you will provide accounting of all charges deducted from security deposit...costs for ads etc.
in TX I can deduct unpaid rents, late fees etc from deposit.

Up to the time the keys are surrendered they are living there, encourage them to get stuff out as quickly as possible so you can get the key and begin to re-rent, this is what will get the security deposit back to the old tenant is re-rented unit that was left in clean condition so it could be turned over fast. Be sure to get the new address and tell them as soon as you can you will mail them back the share they are due, do not offer a check until you have been in there and determine for yourself that all the outlets and lights work and the drains are not blocked, these are classic hidden reasons for moving out and then you end up in court giving back a few months rent for the compensation, the before and after pictures will be your best defense to the former tenant and if you find yourself in court you will be able to explain why it could not be flipped as quickly as they and/or you wanted. --76.241.xxx.xx |
