By law, are is a lessee able to collect their deposit before they moved out? and Can your inspection take place before you're completely moved if you re moving into a house? --64.136.xx.xxx

The inspection should take place after a tenant is completely moved out. I collect the keys at the time of the move-out inspection.

I return the security deposit within the 30 days called for by state statute. I absolutely would not return the security deposit before a tenant is completely moved out, no matter what the circumstances are. --64.12.xxx.xxx

Tiara, that's a beautiful name--a jeweled crown! Be a beautiful person under it and follow the rules of your contract. In almost all states the LL has 30 to return the sec deposit (1 or 2 states have a 21 day or 45 day period--but usually iot is 30). That is because often, the damages cannot be seen till someone gets in there and starts to clean and prepare for a new tenant. Little things add up, having new keys made, carpets so stained that cleaning doesn't help them, backed up drains, grease, markers, tobacco smoke on walls, plastering over nail holes, etc, etc. LLs are allowed 30 to find and repair damages, subtract them from the SD and return the remaining money with an accounting on how it was used. You'll have to wait it out. The better shape you leave the place--the more you'll get back. --66.90.xxx.xxx
