Last September I had to do an eviction and was awarded everything I asked for which was close to $2500.00. The defendant was ordered to pay me $50.00 per month AND she was ordered to pay the balance when she received her tax return this year. I waited 8 weeks after the April 15th tax deadline to receive my money so she could not use the excuse that she had not received her refund yet. Of course I never received it and I am taking her back to court August 6th. I know she received a tax refund because she is a single mother and works full time as a prison guard.
My question is, how do you all think the court will look at this? She ignored a direct order from the court.

If you go back to court, there is a form which she can sign authorizing you to get copies of previous years tax returns. That will provide what IRS processed - not what this person claimed ..... then go from there ..... sounds like contempt if they directly disobeyed a court order ..... --207.238.xxx.xxx |

She either didn't file, or she could have owed money. Just because she's a single mother and a prison guard doesn't mean that she got a return. If she got a return and didn't follow the order it's contempt. But my faith doesn't lie in the court system right now and she'll probably just get a slap on the wrist. --167.6.xxx.xx |

Billy - Yes she has paid the $50.00 every month except this month. Go figure. IMO, Indiana is LL friendly - at least in my town.
Brenda - During the damage hearing the judge asked her how much her tax refunds usually are. She said $3,000 to $4000. Must be nice to get refunds like that. I had to pay this year ! --65.196.xxx.xx |
