Lease terms don't apply if they contradict public policy or state law. In some states, that is enough to void the entire agreement, not just the illegal parts. --192.234.xxx.xxx

Do you mean a garage which is rented by another tenant has a public utility such as electric is on someone else's meter?

Fill us in with the remaider of the story... I am guessing, but the tenant is suing the landlord over the utility charge and the landlord is evicting the tenant in retaliation? Is that what's happening? Are you the landlord or tenant? A friend?

I too have no idea what this is about, but as a general rule, the Tenant filing a lawsuit against a Landlord is NOT ground for the Landlord to evict, but is also not a defense against an unrelated eviction.

If the Tenant can prove that the eviction is in retaliation, that could be a defense. But if the eviction is for non-payment of rent or for a clear violation of the lease, the Tenant can continue his lawsuit against the Landlord from some other residence!

Public service is the former name of Xcel Energy which is a Colorado utility company. So one tenant must have been paying the utilities on a garage for which they were not responsible.

Valerie, living in a rental even while they are suing you are two separate matters. If the tenant is on a lease and they have not violated the lease, then yes, they can stay there. If they have violated the lease, then there may be cause for eviction. If they are on a MTM lease, then you may be able to give them notice to move; however, be careful that this may look retaliatory to a judge and that could hurt the case. --209.181.xx.xx

Sure he can live there,and the LL can not move him out as long as he abides by the lease.

Now if the LL is stealing utilities, then that is a civil or criminal problem, and has nothing to do with where he lives.
