State Specific Question About: CONNECTICUT (CT)

Hmmm, this question came up during recent family discussion so I thought I'd post the question here and see what gets said... (using my current xtenant scenario)

if you give notice to end the rental agreement (month 2 month) within legal time frame and tenant refuses to give up apt keys thus going over legal time frame be it a day or a week, does the landlord have the right to charge the tenant for that day or that week that he held onto the keys AFTER agreement ended? This is aside from any court filings for evictions or anything else. Just curious if tenant is or can be held liable for that time he or she refuses to relinquish the keys. Tried to have this discussion with an uncle of mine this weekend who is very old world Italian... --64.12.xxx.xx

You have the right to charge for time you don't have possession and they do BUT keep in mind that if you accept rent beyond the date of termination you MAY invalidate the termination.

Consider the following...

If Tenant shall hold over after the expiration of the term of this lease, he shall in the absence of any written agreement to the contrary, be a tenant from month to month at the monthly rate of 200% of the monthly rate in effect during the last month of the expiring term. Holdover for one day past lease expiration date implies intent by the tenant to occupy the premisis for the full month and tenant will be obligated for the full month rent at the holdover rate. --70.109.xx.xxx

Irish, Huh?

Okay, so if a tenant occupies the unit and stays beyond the move out date, he automatically reverts to month to month agreement and eviction papers need to be filed.

If a tenant has already vacated the property but refuses to relinquish, say the keys, thus not officially turning the apartment back over to the landlord, he can be charged a prorated portion of the monthly rent until he 1) returns said keys or 2) receives said eviction papers?

CTGF [CT]) This is a EXTREMELY State specific question. With a wide variety of different, legal answers per State Laws and also county to county city to city in some cases.

What will work and is legal in CA will not work and be illegal in CT.

This is one of the areas where State laws must be

known and known well and applied correctly.

So while Irish is correct with the double rent for hold over and if the tenant holds over only one day of the month then they are obligated for the entire month period at double rates in his state and it's laws in MA.

That is not true nor legal in CA. We cannot do either in CA.

I do understand your question and it is a good one. I would like the answer myself. I've never had it happen this way tho.

It's always been they give me written notice and are out by the day they said they would be.(yes some I have to remind them if it isn't a written notice to vacate the premise the 30 day clock has not started)

Abandoned the unit leaving no keys

Eviction who cares about the keys lol.

I won't be using this in regards to my current case, I was just curious. My current xtenant thinks b/c he moved out 2 weeks prior to the moveout date I GAVE HIM he is entitled to his entire amount due and thensome. He just doesn't get it that even though he physically moved out, he didn't give me 1) any written notice 2) any verbal notice he was no longer living on site 3) keys, planned on hanging onto them until he rec'd his money 4) he continued to visit the property daily and left stuff in the apt even after the day after the move out date.

But then again I was told this weekend that my lovely xtenant has been picked up several times by our local PD for DUIs and its a known fact he is very mentally unstable...the only thing that showed up on his crminal records check, however, was owning a vicious dog.....go figure. --70.138.xx.xx
