State Specific Question About: MAINE (ME)

I am a landlord and in the process of evicting a tenant. I have served a "letter to quit" and his 30 day notice to leave is up on July 29th. I suspect he will not leave on that day. What should I do to prepare? Meantime, he is being a nuisance and refusing to acknowledge that I am the landlord and he is the tenant. He is not paying rent. Owes back rent. Has caused damages which he refused to fix. Has a dog who he allows to go to the bathroom all over my property including on my carpeted porch. How do I handle this? He is 20 years old.. very unstable.. has a history of drug use, bigtime!.. Was enrolled in a Methadone Clinic for several months and not sure if that is still on.. Has had other people living in his apartment without letting me know.. has allowed others to utilize my laundry room and machines, no charge to tenants only.. Has used foul language towards me and my fiance.. Is a heavy smoker and has ruined carpets in 2 rooms etc. How do I handle this until he leaves? If he refuses to leave, what do I do? And when did you find all this out... did you do a background check on this person? I hate rude residents....How did you serve the letter to quit and the 30 day notice I hope you used a constable...When did you serve it was it 30 days exactly on the 30th of June...or on the 29th of June...It has to be 30 days....July has 31 days...

Either way if he is not out then you have to proceed with the suit (eviction) please have proof of non payment of rent...and other notices of infractions of the lease you have one dont you)

Go to the court house and get a writ of possession and they will give you a court date...

Did you collect a security deposit..does your lease stimpulate a no pet clause.

Are you in the building...Get the police to come by and see if there are any drugs activity get a police report...for your court files....You just want to be prepared when you go to court if he doesnt move out on his own..Please do not apply the self help eviction as many new and unsuspecting landlords do...Only a judge can evict!

This process is going to take some time...Please be patient...Make sure all notices are delivered in the right manner with the right language...

And default in the language or the way it was delivered could slow the process and you might have to start over...At this point I dont think you need an attorney..you have enough evidence to evict...I am not advising you not to get one though...

You need to take control to get him out. He is obviously not afraid of anything you do or say, but be careful. If he is on drugs, he could be very unstable.

Yes give the police his name and address and have them check it out. Having police reports is very helpful in court. Otherwise it is your word against his.

How did someone on drugs get into your unit? Did you check him out on the court website, if your state has one? Good Luck.

If he is not out by the 29th go down to the court and file for eviction. They will give you a court date. All you have to do is take your rent book with you showing that he has not paid rent and the lease and copy of the notices you sent. The court will send him a notice and probably he won't be there and automatically lose the case. Meanwhile ignore all the problems and don't go near him and wait for the 29th. There are a lot of people who have no rules. Prisons are full of them. --76.99.xxx.xx

Why does he have to wait until the 30-days is up? Do you really need a 30 day notice in ME for NONPAYMENT OF RENT? He says that they guy owes BACK rent. Shouldn't he be filing for eviction for nonpayment? Not a 30-day notice to quit for violation??

if u have not evicted before i think u should get a landlord tenant atty.maybe someone knows someone or see a local landlord group or maybe u have a friend in the biz who can recommend someone or see yellow pages.no pay no stay is usually pretty routine in my experience.he usually has to pay or get out.where did u get this piece of crap?did u screen him before renting to him?credit,court,police or criminal,last 2 landlords?see credit checks above before u need it.good luck --208.58.x.xx
