State Specific Question About: WASHINGTON (WA)

My renter (lessee) is moving out without notifying me. He is breaking the lease which is not up until April.

He has not paid July rent. Half of his belongings are still in the house. When can I take possession of my home? --98.165.x.x

As soon as it can be recovered legally, meaning you have to get the keys returned and forwarding address so you can square up the security even though they wont be getting it, helps the next time. I meant to reply last night but I forgot.

Anyway, this is a judgement call for you. Do you think they are really gone? Do you think they will turn this into a legal fight for possession? Do you think they will want their stuff back?

In a similar case where my tenant left, leaving stuff behind, I did this: nail/mail a small notice saying that the property appears abandoned according to RCW 59.18.310, and that the tenant must contact you within 2 days if they are still living there. Otherwise, you will declare the property abandoned and proceed with a second nail/mail notice following RCW 59.18.310. If you are a member of Rental Housing Association of Puget Sound, they have a form for this first notice. The 2nd notice can be downloaded by googling for: "ltservices notice of abandonment"

Per the RCW, you need to store their stuff for so many days and can sell it later to offset your costs. Don't forget to charge them for storage and drayage , if they want to reclaim their items before the sale. --24.22.xxx.xx

I really have no interest in their belongings and want to be sure they get all of it. I am more interested in getting the rent so I can pay the mortgage. Now they say they are finishing moving in another week. They don't say anything about paying and won't tell me even what city they are in. The deposit will not cover the amount I am out. --98.165.x.x

Issue a 3 day pay/vacate notice. If you talk to them, tell them that their antics are going to cause them to be evicted with a court judgement and credit report impact. --199.3.xxx.xxx

I consider a move out without notice abandonment. Abandonment subjects my property to possible damages and therefore per TN state laws when my property is threaten with damages I have the right for immediate possession. And I will exercise that right if my relationship has not been good with the abandoning tenant. Take control of your properties. Don't wait around for those proper authorities to do something. Just know your laws and be aggressive. --65.6.xx.xx
