Nanci, it's always best to use the state required notices for anything that may lead to an eviction. Here we issue 3 day pay or quit notices with specific language when tenants are late. AL will have a similar notice; hopefully an AL landlord will be along with better info. But if not, the link to state laws at the top of this page will get you there.

Letters for something such as this typically don't work and will possibly complicate an eviction if necessary. --68.111.xxx.xx

Thanks very much. So you think it's better to just do an eviction notice after a couple of weeks or so, instead of a "your rent is late?" I live in NY and am a tenent. If my rent is late (seldom) I would get a "we have not received your rent, if it is in the mail, please disregard."

How would they complicate the process, I don't have a clue? --65.215.xx.xx

Gentle reminders are useless. The tenant knows he is late. A gentle reminder does not protect your right to proceed with an eviction. States use specific language for notices. These notices are not eviction letters. They are notices that the tenant is late and they have so many days to correct the situation. It is the legal requirement by law to protect the rights of the tenant to correct the situation. --64.218.xx.xx

if one of my good tenants is late i call them on 5th.i want to stay on good terms with them.they get the notice to quit sent on 6th if still no rent.if its a chronic slow pay i send the notice to quit on the 5th.constable serves it. --208.58.x.xx

billy do you find that by having the constable serve the notice to quit that this cures the late pay tenants?

I would use a Police officer here in CA. Are constables uniformed? I don't have any problems

currently with late pays, knocking on my wooden head... Might need it in the future.

I send out a "gentle reminder." Many times that takes care of the problem. If it does not, I serve a 5-Day Notice To Pay Or Quit.

The cost to the tenant if they pay on the gentle reminder is the late fee. The cost to the tenant if they wait for the 5-Day Notice is much higher (5-Day Notice preparation plus service processer fees). And if they don't pay then, well, the cost is the Unlawful Detainer action.

I do not think the "gentle reminder" complicates anything. To the contrary, it simplifies things. After all, if the tenant wants to claim "I mailed the check on the thirtieth," my question in court is "Did you call the Landlord after you got the 'gentle reminder' to tell the landlord that the check had been mailed?" "Did you call the Landlord to follow up and see if the check had been received?" Because my "gentle reminder" does not say "ignore this if you paid." It demands a response.

I post a "not so gentle" reminder if I'm being dodged. But I call first. On one occasion years ago the tenant really DID forget and rushed it to me on the 2nd, after my call. So I give the benefit of the doubt...ONCE.

I am with Mike45 (NV), the reminder speeds the process. The reminder is part of my procedure, not a deviation from it. I live in my own building and see my tenants quite often, so like billy button, I prefer to stay on friendly terms with them. However, I just cannot sit and say nothing for 5 days while someone is stealing from me right in front of my face. So, this reminder is my compromise.
