State Specific Question About: NORTH CAROLINA (NC)

hey all...hope everyone is fine...well my issue is i work in a property management office so of course we handle several padlocks/evictions and stuff...now we have had judgement for possession on this one girl, she knew that she would be padlocked and the time came...the 10 days have passed and she calls us screaming at all times that we must let her in...now, this morning i went to her beloved apt and found bags upon bags upon bags of garbage bags full of crap...also a tv and couch and some bicycles...nothing that we can make money off of to cover back rent and court costs...but she starts off all sweet and ends by calling me horrid names(not the first time that has happened, surprised anyone??)anyhow, is that considered harassment or something...she needs to quit or i am going to tell her yeah, she can get her crap...from the dumpster...lol...anyone had anything similiar?? or some wise words???

That was a little harsh (making age disciminatory comments)! There are plenty of people that are "old" that still don't capitalize and cannot spell. Anyway, it sounds as if you did all the legal things that you needed to in order to get possession of the unit back. But even if you were to leave the stuff for her lets say on the front lawn and give her a day and time to come pick it up, she probably won't stop harassing you if she's going to end up being sued. --167.6.xxx.xx

i am 32 years old, and i spend my whole day using caps and i quite honestly did not think i was going to be graded on my question...i usually have a great experience with mr. landlord and have been helped out...as for eviction laws i am familiar and i posted it earlier...i was asking what to do about a harassing tenant...but thanks for the kind words...i appreciate it....

also, i would just like to know when mr. ll ranked on the people asking questions instead of helping them...but such is life...people are mean no matter where you are...

have a great day Wallace...and may you never have to deal with a person such as this girl...only tidings of blessings to you...for i am mature enough to not hold ill will...

I find it best to let the tenant have their stuff. It saves me from having to haul it to the dumpster. Also, it may prevent you from dealing with someone kicking down the door to get their stuff. Prosecution is tough if you don't have a good witness. --149.168.xx.x

Ignore the harsh comments above.

In your situation, your goal needs to end the relationship with the tenant. Ignore the harassment. Don't tell her any fancy words. Just call and say that she has one opportunity to get her stuff or it is going in the garbage at her expense. Agree on a mutually convenient time. If she does not show, then move on. I don't know your laws for tenants left possessions in VA. I do know them for CA. They could be very different.

Until I knew exactly what those laws are I wouldn't make any moves that could foil my property owners rights.

The ca laws are very detailed and exact. I tried to get the tenants to take as much as I could. It worked out ok. It could of been a huge hassle if it had gone differently.

Make her feel that you are doing her a favor. By allowing her to pick up her stuff as a appointed time and date. Once that window is closed that ends your obligation to her. Make her aware of this. Is how I would do it per ca law. Make it clear

she is there to move things. You have to be there the entire time to protect the dwelling. If she mouths off. You have the right not to put up with the abuse. Make her aware of this before hand also.

speaking as the person who does all the move out inspections and padlocked apt/houses...i am familiar with dirty nasty horrid filth...i must give her one thing though...the trashbag mountain is flush against the living room wall and besides the couch all the other rooms are empty... so there is always a plus side isnt there???

Things are quite different in my state in Wisconsin. Even if we get possession, if the tenant leaves possessions behind that amount to $100 or so (they will always say the stuff is worth more though), we need to either leave it all in the unit and have a lock in place done for 30 days, giving her that amount of time to claim her stuff, OR we need to pay to have it moved to storage. In order to redeem, she would need to pay for moving and storing it. You cannot hold items for anything other than moving her stuff and storage.

I would let her know by phone, that if you let her in, she needs to TAKE everything that she left, starting with the garbage and then have an officer there to be sure it is taken.

Otherwise you could also just have her take what she wants and charge her to dispose of the rest, but probably would not get anything for hauling out the rest of the junk.

You are lucky in that you can just get rid of the rest. Here you need to move and store it or lock in place for 30 days. In this case, I may have been able to claim under the $100 value, but as stated, tenants always think it is worth more.

Good Luck...By the way, you will find that most landlords on here do try to help when they can.

I tend to agree with Joe and Josh. But I give the former tenant endless opportunities to access the unit. I want the former tenant to get as much of their crap out as possible, so I don't have to.

I had evicted the tenants of a 4 bedroom house. They ignored all of the notices and court papers, and didn't move anything whatsoever until the Constable showed up with a locksmith to kick them out. I was left with a fully furnished (with junk) 4 bedroom house. I was going to have inventory and store everything, hold it for the statutory period, sell it, account for the costs and proceeds, ... I wanted the former tenants to take all of that off of my hands. I gave them access time and again. But the house was so badly totaled by them when they were locked out that I didn't even bother to supervise them -- they couldn't do any more damage! I just went by when they called, to lock the place up. Because of my kindness, I only had to pay fill up and to haul away one large dumpster (does 30 cubic yards sound right?), instead of three loads of that huge dumpster. Saved me a ton of money and hassle.
