State Specific Question About: NORTH CAROLINA (NC)

ok this is too much to handle, but let me see if anyone can help.

there was a mom(jane)daughter(jill)fiance to jill(jack) living in one of our units...jane and jill decided to move out leaving jack(21years old) there to take over the unit...no paperwork has been done as of yet...

turns out jack is the son of a sheriff...he was very arrogant when he had his application run telling us that he has some things against his criminal but none to deny him from getting an apt(wait, does he own us?)needless to say he remained as an occupant..but now the flip has switched...

we got a report from a tenant stating this guy was kissing and "messaging" a nine year old(which bugs the hell out of me cos i have a 9 year old)

anyhow, when we found this out we phoned the police-they stated no reports were filed...lets recall his daddy is a sheriff...

anyhow, upon fruther review of other tenants they stated cops were out there over 3 hours the other day...so my boss called the police yet again and they said yeah there was a call but nothing to back it up, and get this--they told my boss it is not their job to go door to door to investigate...what? yeah it is...

so has anyone had anything similar?? he is not a registered sex offender and his criminal is just some misdemeanor charges or something...

what to do??? we want him out, but apparently that sheriff dept is not helping at all...

we are thinking of calling the s.b.i on the sheriff's dept cos this cover up is sickening...its a little girl...

any suggestions???

I don't understand a number of things about this situation.

Who are you? Are you the landlord? You mentioned your "boss". Are you working in a leasing office?

Why on earth is this guy in the unit when "no paperwork has been done"? Or do you mean all three were appropriately screened (credit, criminal history, landlord references, etc), and now that the other two tenants have moved out, you think you need to change something (you don't - you leave the other two on the hook on the Lease).

Were they screened?

Is the rent paid? If so, you can proceed by having the tenant who actually saw the incident with the 9 year old call the police and report it. If not, file an eviction on all tenants on the Lease.

wow sorry i did not mention more but i am sooo wrapped up in this...ok i work for a leasing office...yes, all three were screened, both jill and jane were clean...he had a couple misdemeanors...nothing that outrageous...

as for the paperwork i was meaning that jill and jane want jack to take over the lease and said they have since moved without even doing the paperwork...as for rent, let me check...yup paid up...foo...

ugh..

Sorry, but I agree with the cops on this. It is not their job to go door-to-door trying to dig up evidence based on the call from someone that heard from someone else that they were seen kissing some kid.

That isn't anywhere near enough for a warrant, of course. So -- what could they possibly do? The guy isn't going to admit to anything -- and they can't just go in and snoop around.

Therefore, with no evidence to go on and only a word of mouth report from someone that wasn't even the witness -- exactly what do you want the cops to do here?

The only question is whether or not you are going to let the other two out of the lease. It wounds like you would not normally have accepted this guy by himself -- so why are you letting him continue by himself?

If this is a long-term lease, then I would NOT let the other two out with him just being left. I assume you have a joint and several clause. Make it clear to them that they are responsible unless ALL of you are out. Let them get him out.

If it is a month-to-month, then just terminate, get him out, and move on with new tenants if you are that bothered by what you heard from someone else about him.

You could report him to Children & Family Services , or the equivalent in your state. In Illinois, this can be done anonomously. Is he on a month to month or a lease? You may be stuck with him until lease runs out unless he fails to pay rent or is in violation of another clause of the lease. I know other landlords have posted on here that they have offered $ to the tenants to leave. I have never done so personally, but I might to get rid of someone like him. --98.215.xx.xxx

thanks john you gave me another point of view on it. i normally would not jump the gun on one person calling a complaint, i would take the complaint as normal but until i get the other person to dispute the complaint(which the innocent ones usually do)but my complaints are usually loud music, public drinking, etc...but not only did the mom of the child call the police as well as us...but the neighbor who saw it called the police...

i think i should just squash the whole issue with the police...i am sure if they had some issue (regardless of jack's fathers position in the small community) they would look into it...i would sure hope so...its my motherly instinct kickin in wanting to whoop someone...but such is life..i am relaying all your suggestions to my boss and hopefully we can get them out...

ugh and foo...

you see we mainly deal with a really big county for most of our rentals...but this one rental is in a small mountain town that is quite small...and you know how word is in little towns...

Good for you to try and get the pervert out ASAP. I teach courses for other teachers on how to make these reports - like the others stated - call child protective services or the equivalent in your area. That is who handles all of these issues. OK, it was a TENANT that report this to you. If the tenant and Jack may have had an arguement or maybe the tenant does not like Jack. Tenants have been know to fabricate bull sh!t stories in an attempt to get fast results from management. This may be the case.

The reason why I think it is a fabricated story is the fact cops will NOT look to other way if the story was remotely true. Since Jack is the Sheriff's son, Jack may know and hang out with his father's subornates. It is possible the cops were goofing off at Jack's apartment for 3 hours the other day and when questioned about it, they you were abruptly shot down and sent on your way.

Beofre you call in the army, navy and marines about this incident, you better make sure the story is true and not fabricated from a tenant. If it is true, take action on Jack using the appropriate channels.

She heard from someone ELSE -- who DID report it -- about the situation. That is NOT being a witness to a crime. Therefore, it is NOT a crime to fail to report whatever rumor you heard from someone else, sorry. Even in Indiana.

1) what timeframe are we talking about here--how much longer on the lease??

2) who signed the lease? I'm guessing JANE. Is Jack listed as an authorized occupant?

3) How long has it been since the girls were there? Has Jack been paying every month in full?

If you want him out, you may have to work on getting him out--and one way to do that is to clarify(or muddy) his right to stay in a unit on a lease you had with someone that has long left. He only had a right to be there as part of that family. If he did not sign that lease--you have no lease with him--just with the mother. Did she give you any kind of notice? Did she turn in HER sets of keys? Maybe if you had notification and keys turn-in by the contract tenant--then he would be a squatter. --140.140.xx.x
