State Specific Question About: CONNECTICUT (CT)
Bear w/me, this is question number 2...and forgive me if I'm moving ahead, I am thinking and planning and figure I'll ask the board for opinions.
in previous post I noted tenant has moved out of apt but has paid rent until June 19-when his rental agreement w/me officially ends. He has 3 large items remaining in the apt but otherwise nothing essential is still there.
He has not relinquished keys and as you know by previous posts is being a naughty tenant.
What should be happening on June 20th (the day after the agreement officially ends) if 1) I do not yet have keys to the apt back in my possession, 2) items remain in the apt (which I doubt they will, honestly, he's a jerk but I doubt stupid)
Does the apt return to my possession on the 20th since he is not living in the apt. Do I need to prove that/how?
Can I change the locks, legally, on the 20th ? Or should I still plan on going to the court house? I do not have a forwarding address and doubt highly he will provide me w/one. I never had a telephone number for him (he has a cell but its on/off all the time).
Again, thank you all for your wisdom....psst, the apt has been closed up tight for over 12 hours now since the viscious rain storms last evening (I closed all the windows to protect the integrity of my house) and I wonder if the cig smell will be there when he comes back!!!

Its nice to have the reassurance of the board and seasoned LLs to refer too...I have the CT Landlord/Tenant booklet but hearing in laymen's terms is alot easier to absorb.

Do these three 'big' items have any real market value? Or are they in the "will cost more to move than they're worth" category? (I'm gonna assume the latter.)
Long story (about CT law & certified mail etc) short... these items will soon be in your care and control to do with as you see fit. Ideally the next tenant will like having them but if not, Goodwill etc. will take them.

I look for one of two things to gain possesion of my unit.
1) Keys - if the resident hands the keys to me I can be assured that they are returning my unit to me.
2) Something in writing from the resident stating that they have turned the unit back over to me.

The stuff remaining in the apt is of minor concern. Every tenant seems to think its not their problem if they leave something behind.
What I am asking is do I have the right to change the locks on June 20th if he has not given me back the keys or notified me in writing that he has indeed moved out?
Or is the fact the agreement is 'over' on the 20th and he has not been 'living' here since Friday night and I assume will not return to live here, enough for me to be able to legally retake poss. of the apt or do I still have to serve him some kind of notice? --64.12.xxx.xxx |

CTGLF [CT], does he/she hold a copy of a valid rental/lease agreement indicating possession? What expiration date? You have a copy too right? Good, remove the deadbolt locks and install your new/old set, mark the edge of the lock at the door with nail polish and mark the old deadbolts with a different color along with the keys, done. Now put the old locks somewhere cause you will use them in a year or 2. Go back inside and photograph the damages, get estimates, make copies of both pics and repair slips, send to outbound tenant with the green card from the post office, keep that reciept in your strong box in case you have to head to the courthouse. Take a short break and start cleaning everything so the contractors can eat from smooth countertops, let them do what they need to do so you can re-rent to the next bum, welcome to LLing. Oh the propane tank will prolly end up inside your window if ya keep nagging this old tenant, so give it to someone you know who can use it for a cookout, if ya go drink like a fish so nobody has to hear all the landlord woes you got last week. --99.161.xxx.xxx |

Thanks Virden...good advice. lol-ing about the drink like a fish! Seriously, I've been doing this (landlording) since I"m 25 and now am 42. I'm very lucky as I only had 1 court eviction in all that time. got rid of a few early but w/o any incident. I do screen (which amazes me that some slip through the process b/c they know exactly what to say/do). Just amazes me....I have been a tenant throughout the years so I guess I expect others to be as I was...Ha! never. Next bum....probably. Very sad.
Anyway, thanks....don't know why but the visual that accompanied your comment about the tank coming through the window made me laugh. Guess because I could see it happening. They are gone... (no food or bedding) and no more being woken up by his walking as if he were a 500 lb elephant each morning (hes a small guy but walks so heavy) so I'm in heaven.

if they have not given back keys they could argue they still live there.i ask for keys .maybe twice.i sometimes offer a few bucks for keys.once u have keys they are gone.it works better if the rent runs from the first .easier to keep track .i wouldnt do anything until after the 19th since he is paid to then. --208.58.x.xx |
