I am relatively a new landlord (1+year)and have a question. My new tenants had NSF ck plus 14 days late fee. they are refusing my emails and phone calls for request to pay up on these fees. They did deposit the May rent on the 15th of May. Now they are demanding hot water repair in the 2nd bathroom shower.

Is my understanding correct that the June rent goes towards the $160 unpaid fees first. making them below in there rent payment for June. Can I hold out repairing their hot water shower (house has 2 bath/showers) until they pay up late fees plus full rent? I am waiting to see what happens with the June rent before I decide to evict.

It all depends on how your lease is written, if your lease is not written that way then you cannot have unpaid fees go towards rent. Although you could subtract them from their security deposit when they move out.

You should not hold out on repairing habitability issues, I am assuming this is one, to retaliate for nonpayment of fees/rent. If you do that, you're giving them ammunition if you go to court.

Repairs are one thing, rent another. I'd fix anything needing repairs when the problem arises. You may find that while you are there, you can talk. Maybe even get a check for the $160. --24.21.xx.xx

If you dont fix the shower, it will look badly on you at the eviction hearing.

I would tell them the time and date you will be comming to fix the shower and you are awaiting their call to confirm the appointment. When they call, tell them you will pickup the cheque (cash) at the same time. --74.12.x.xxx
