State Specific Question About: NORTH CAROLINA (NC)

On 5/5/08 a prospective tenant gave 1/2 of security deposit to hold apt and completed rental application. I stopped showing/advertising apt. Now almost 10 days later, tenant has changed their mind. Now I have to start searching for another tenant. How much of this security deposit to 'hold apt' can I legally keep? Rental is in NC. --192.234.xxx.xx

What did your holding agreement say? I did one recently that specified it was nonrefundable if the tenants didn't move in. But if they did, it was applied toward the security deposit.

Also, in the future charge a NON-REFUNDABLE HOLDING FEE that will be applied to the move in monies when the lease is signed and rent is paid and the resident moves in and that will be forfitted if the applicant fails to take the unit. --75.13.xx.xx
