Hello ,

My tenant is is over 10 days late with rent and won't answer phone or emails (this is typical when they owe rent). MGMT.Co. can't get in touch with them. I have issued the pay or quit notice already and filled for eviction. Anyway, does anyone know any tips or tricks to get them on the phone or any ways to get in the house? Just curious.

Just leave them a note asking for forwarding address and possible phone number so you can square away the security deposit, then everything else goes in certified mail - damage cost, late fee, rent, blah-blah-blah. Keep the green cards and returned mail for clerk of court. --76.241.xxx.xxx

Since you've already filed, just wait until the court date. I cease all attempts to communicate w/a tenant once I've had to serve a Notice of any type.

Unless you have a legit reason to enter the apartment (other than curiosity about them still being there), you're probably better off leaving well enough alone--and no, the "thought I heard water running" excuse won't fool a judge. There's no sense in creating a possibility of having them accuse you of harassment.

If they want to pay and stay, they'll either contact you (or the PM) to make good on the late rent. If they don't, they'll probably blow off the court date and you'll win by default. --72.93.xxx.xx

Guess, I'm a bit different.

When a tenant doesnt pay me, I usually feel my property is threatened.

First I start the evic process. Then depending onthe circumstances, I give 24 hour notice of repairs and start to do small repairs. Perhaps once or twice a week.

I want to know what is going in the unit. I want the tenant to know they are not in control, and as I expect to have to re-rent the unit, I want to begin the work that usually has to be done. --74.12.x.xx

Yes, I do have the 10% late fee in lease. However, I haven't received anything. If I do receive anything it will probably be just the rent with no late fee. I hve had this happen before with tenants. They hope i will accept just the rent and forget about the late fee. --70.182.x.xxx

I agree with Billy Button, you dont want the tenants going to court accusing you of harassement. No phone conversation whatsoever, everything in writing only. And if you have to go over there....make sure you bring an independent party..... And also document your visit. Because if there is any damagae whether or not you are in there....Those damages will be deducted from the security deposit....And if the are Sect 8 always Cc: them in case they claimed they didnt get the mail..... --75.69.xxx.xxx
