State Specific Question About: NORTH CAROLINA (NC)

This question is for north carolina only, The tenant laws i'm reading, the first step is to give the tenant a 10 day notice when they are late on rent. Is this the notice to pay or quit form?? I have one that hasn't paid up this month and i'm not too optimistic about seeing the rent from them, I want to start the eviction process today.

The question isn't for NC only. It's a problem that new/inexperienced LLs from all over the country run into daily.

The answer applies to all 50 states:

Contact an attorney who specializes in LL/tenant law and have him/her handle it. Request copies of all Notices and correspondences, ask questions, take notes, and file it all away for future reference. Consider the expense to be the price of a very valuable education. --71.174.xxx.xx

Agreeing with T.T. BTW, John, don't take this too hard but READ YOUR STATE LAWS IMMEDIATELY! Then read them again, and a third time. Find a competent lawyer who specialized in land lord / tenant law and become friends with him/her. Ask questions about everything that you don't understand AFTER doing your homework. If you've been land lording and don't know the first thing about evictions you are way in over your head and are going to get the crap kicked out of you by professional tenants. Harsh but true. Been there and had that done to me, even though I did know the law. Do the right thing now and you'll rest easier next time it happens (and it will). --168.166.xx.xx

Actually the tenant called today and says that he will have the rent on the 15th.

All I want to know if the first step which is I belive posting the 10 day pay or quit notice right? That is all I want to know, enough about you better be careful and you are way in over your head, I have read the laws, just need a helping friend that has been though this to confirm some stuff.

My closing attorney told me the eviction process is simple and you don't need a lawyer. --71.77.xx.xxx

Whether you have 1 or a 1,000 units, learning your local LLing laws & customs before you actually need them is crucial to being a successful LL.

If you start the eviction process as soon as your state allows, you will be more in charge of saying whether your tenant stays or goes. --151.203.xxx.xx
