State Specific Question About: IDAHO (ID)

We had a fence put up around our victorian 5 plex that is on a very busy corner. Got the permit & did it to spec/code. Yesterday I got a notice of violation in terms of the CVT (Clear Vision Triangle). Now, how can they do that when they gave us the permit, we angled the fence & set it back to their requirements? I'm at a loss!Any one else had to deal with this type of deal? --69.92.xxx.x

I assume it was inspected and passed subsequent to the letter of violation, right?

I'll tell you how it can happen here. Build Dept "gives" out fence permits and they check "design" against zoning/building code. This mostly covers height. Then the streets dept gets a claim, "hey this new fence blocks my view" streets inspector visits new fence and says hey we don't have the sight triangle and sends notice. Should not happen but it does.

John, They issue the permit & I don't think they come out and check here in Idaho. I guess the permit dept & the code enforement office are two separate depts and one hand doesn't know what the other is doing. Just isn't right. Why bother getting a permit if you aren't covered. Irritating. --69.92.xxx.x

Here they issue the permit and then come out to sign off on it. If it's within the code requirement, they gotta' change the requirement to try to make yours illegal.

Go to the department listed on the notice to find out who tagged it and get the specific problem they noted. Then prove your point and let them tell you what has to be done to make it happen.

The devil's in the details...always. --68.1.xx.xx

I contacted the code enf.Officer who signed it. He is actually trying to get a few things changed for me so I don't have to take the fence back further. From what they say, this is a problem for many people. City wants the $ for permit & doesn't really care if it's up to code or not. I thought someone would have visited to make sure before signing off, but no. It's a racket! --69.92.xxx.x

I have to call the inspector to get the sign off at various states. They don't just show up unless they get a complaint. --70.19.xxx.xxx

It has been our experience here in Northern Idaho to be general a 3 foot height is permitted in front of units and 6 foot from front/side to backs of properety lines. This is allowed for the viewing issues. Go back and see what boob inspected the fence or by what guide lines/stipulations they placed on your fencing issues.

I do not see this as a landlording issue but a owner/city dispute.

Good luck and happy landlording. --68.238.xxx.xxx
