State Specific Question About: IDAHO (ID)

Our tenants abandoned our home. They signed a 1 yr contract and only lived there one month. My question is, in our contract it states that they can only have the security deposit back if they fulfill their contract and since they are breaking it, we feel that they forfeit their security deposit. --65.39.xx.xx

First of all, your lease should spell out what would happen if the tenant vacates before the lease expiration date...

Even if you lease does not state that...you have very valid grounds...

Next...now that they have vacated, you need to send an accounting for the security deposit to them, i.e., say that their security deposit has been used toward the unpaid rent for the remainder of the lease contract.

Next... try to clean up the property and make intensive efforts to re-rent...

Finally, when you finally get the property cleaned up and re-rented, file in small claims court for cleaning charges that are not normal wear and tear, and lost rent and advertising and utility costs due to them breaking the lease for the vacant period... --71.168.xx.xxx

In your lease, you may proclaim yourself Emperor, but that doesn't make it so. Your own states statutes spell out what you may and may not do with a tenants security deposit. There is clearly not enough information to intelligently answer this query.

Generally speaking, If your renters surrendered the property in good and clean order to rerent as a military issue, I always work with them. Give it to them.

If they surrended the property because mom died and they needed to move and you got it rented in two weeks of vacating, I would charge the regular fees like advertising, carpet cleaning, etc....

hopefully you lease states that willfully refusing to pay or early breach of contract you get to.........

then it would seem more prudent.

Tighten up on your contracts and be case specific for a more qualified answer.

If they fled in the night and did not surrended then that is another ballgame and requires $ and work on your part to re-enter unit to gain lawful possession.

This is a fun one but to many unknown's
