State Specific Question About: WASHINGTON (WA)
Hi-
We are wondering what to do when a tenant has given official proper notice of intent to vacate but is still on the premises on the date the owner has agreed to take possession. Can the landlords enter the dwelling? If the Tenants are still there or have belongings there, what are we to do?
We have tried working with the Tenants by suggesting that they "annull" their original intent letter in an official signed letter to us stating as such and then we would agree to continue on under the current rental agreement and they would then deliver us another intent to vacate after paying rent on time. But we have not recieved a response and the end of the month is approaching.
They called us the day after we recieved their certified letter of intent and said they thought they might not be able to make the declared move out date and could we let them remain in the house as long as they need to and prorate rent?

Here I would collect the full months rent and then rebate them the difference if you are so inclined. They may stay another two months and you may not collect from them. If they do not vacat start eviction proceedings --72.22.xxx.xxx |

In this case, you work with them and make the best of a bad situation. Else, you give them a 20 day notice to terminate tenancy. Are you on M2M or a lease? If M2M and on calendar month as is typical, a 20 day notice given today would mean that they'd need to vacate by 5/31/08.
In WA, notice to vacate is given per rental period, not per 30 day period. So they can't leave in the middle of a rental period and be prorated.
In the future, I'd recommend serving them a 20-day notice to terminate as soon as they give you their notice. This will give you the ability to start the eviction process if they don't move on time.
Don't let them push you around!! They are trying to make you accomodate their lack of planning.
